Colorado payday-loan rules: the direct answer
Colorado permits a regulated payday product called a deferred deposit loan. Under the 2026 Colorado Revised Statutes, a licensed lender may finance no more than $500, the finance charge may not exceed a 36 percent annual percentage rate, and the written term must run for at least six months. Those limits replaced the older model of a large fee due after one payday.
The product remains expensive even at the legal ceiling. Colorado requires a supervised lender license to make deferred deposit loans, including covered internet activity. A national request form does not establish that its responding creditor holds the required authority or will offer a Colorado-compliant product.
The offer profiles below are comparison starting points, not approved Colorado payday lenders. Identify the legal creditor and any arranger, verify the license, and read the amount financed, APR, finance charge, payment dates and debit terms before treating a response as available.
The $500 ceiling, six-month minimum and 36% APR
Section 5-3.1-106 limits the amount lent and the amount financed by one deferred-deposit lender to $500 at any time. Multiple agreements do not create extra capacity when their combined financed balance would exceed the ceiling. The agreement should make the amount financed distinguishable from the total amount repaid and from any attempted add-on product.
Section 5-3.1-103 now sets a six-month minimum term and no statutory maximum term for this product. A site that promises repayment in one or two weeks is not describing the current Colorado deferred-deposit structure. A longer term reduces the size of an individual scheduled payment, but the borrower still needs to compare total repayment and the number of pay cycles affected.
Section 5-3.1-105 caps the finance charge at 36 percent APR and permits only charges expressly authorized by the Deferred Deposit Loan Act. APR is the comparison rate, while the finance charge is the dollar cost. Both belong in the signed disclosure; a service estimate, advertising example or maximum network range cannot substitute for the creditor’s figures.
What a six-month Colorado cost example shows
For a neutral illustration, amortizing $500 over six equal monthly payments at a 36 percent nominal annual rate produces a payment of about $92.30. Scheduled repayment is approximately $553.79, including about $53.79 of interest. This is a mathematical example rather than an offer; actual disclosures can differ because of payment timing, rounding and contract structure.
A quoted payment should be tested against the borrower’s pay schedule and essential expenses. Six payments of roughly $92 can be easier to absorb than a $500 balloon, yet they still reduce the household’s available cash for half a year. Compare the balance after every payment rather than assuming each debit reduces principal by the full amount.
Use the installment calculator with the final contract values, then compare its estimate with the Truth in Lending box. A difference can signal that the stated APR, term, deducted proceeds or payment frequency was entered incorrectly. Do not add an optional membership or expedited-transfer fee to the loan unless the service makes it a condition of receiving the advertised credit.
A lower APR or lower-cost noncredit arrangement may preserve substantially more cash. Compare complete dollar cost and repayment duration, not approval speed alone.
Written agreement and next-business-day cancellation
Every Colorado deferred deposit transaction and renewal must have a written agreement signed by the consumer and lender. The statute calls for the transaction date, amount of the payment instrument, APR, total finance charge in dollars and as an annual rate, and the name, address and telephone number of every agent or arranger involved.
The agreement must identify when the check or electronic authorization may be presented. It also must accept prepayment without a penalty. Save a complete copy before leaving the page, because a confirmation email or dashboard total may omit the arranger identity, finance-charge calculation or authorization language needed to review a later dispute.
A consumer may rescind by 5 p.m. on the next business day following the transaction. Use the contract’s stated method, keep proof of delivery, return the proceeds as instructed and request written confirmation that the loan and debit authorization were canceled. Waiting until the next scheduled payment date does not preserve this short statutory right.
Online lenders, license checks and Colorado’s opt-out
Colorado’s territorial rule can cover a transaction when a Colorado resident enters it with a creditor that solicited or advertised in the state, including through the internet. The anti-evasion provision also reaches a person who assists or arranges a higher-priced loan electronically, even without a physical Colorado storefront. A choice-of-law sentence does not answer every coverage question.
Search the Colorado Attorney General Consumer Credit Unit license report by the creditor’s legal name, not merely the marketing brand. The marketplace, bank, nonbank lender, servicer and collector can be different companies. Record which entity actually extends credit and which one only transfers the application or services an account after funding.
Colorado opted out of specified federal rate-preemption provisions for consumer credit effective July 1, 2024. The 2026 statutes note a 2025 federal appellate decision concluding that the opt-out reaches loans from out-of-state state-chartered banks to Colorado borrowers. Bank-partnership analysis can still be technical, so preserve the agreement and ask the Consumer Credit Unit or qualified counsel rather than accepting a generic “bank issued” claim.
Renewal, prepayment and consecutive borrowing
A deferred deposit loan may be renewed no more than once. The renewal finance charge remains subject to the 36 percent APR ceiling, and an early renewal requires a prorated refund for unused time on the existing charge. After the permitted renewal, the borrower must pay the debt rather than continue extending it as the same payday transaction.
Prepayment before maturity carries no penalty, and the lender must refund the prorated part of the finance charge based on time remaining. Ask for a dated payoff quote and reconcile the refund with the original schedule. A new supervised-loan refinance is a different legal structure and should receive a fresh cost and term review.
The $500 outstanding limit is not a safe borrowing target. Track balances across related brands and determine whether a proposed “new” agreement replaces, refinances or sits beside an existing obligation. Repeated applications also multiply data-sharing exposure when each form routes sensitive information to several businesses.
ACH debits, returned payments and collection limits
Read the payment instrument separately from general website consent. It should state the authorized company, amount or calculation method, presentation date and procedure for revocation. Do not provide an online-banking password, and never pay a supposed release fee through cryptocurrency, a gift card, wire transfer or person-to-person payment.
For a dishonored instrument, the Act permits one contracted returned-instrument charge per deferred deposit loan, capped at $25. Court-awarded costs and reasonable attorney fees can apply within statutory limits, but the lender may not invent additional default fees. Bank overdraft or nonsufficient-funds charges are separate costs imposed by the account institution.
A consumer generally is not subject to a criminal penalty merely for entering a deferred deposit agreement or because the instrument is dishonored; the statute contains a specific exception involving an account closed before the agreed presentation date. Preserve collection messages, dispute inaccurate balances in writing and do not ignore a genuine court notice.
Colorado comparison checklist and alternatives
Before borrowing, ask the biller for a due-date change or hardship schedule. Compare a credit-union small-dollar loan, employer advance, regulated bank product and assistance located through Colorado 211. When a dispute involves lending, licensing or debt collection, submit a detailed complaint to the Colorado Attorney General Consumer Credit Unit with the agreement, advertisement, payment history and company identities.
- Confirm the product is a Colorado deferred deposit loan rather than an unclassified cash advance.
- Identify the originating creditor, every arranger and the company authorized to debit the account.
- Verify the supervised lender license in the Colorado Attorney General’s current report.
- Check the $500 financed-amount ceiling, six-month minimum term and all-in 36% APR limit.
- Save the signed agreement and calendar the 5 p.m. next-business-day rescission deadline.
- Compare total repayment, early-payoff refund, renewal consequences and essential-expense margin.
Colorado payday-loan FAQ
- Question 1Are payday loans legal in Colorado?
- Answer
Yes, but only within the regulated deferred deposit framework. The product has a $500 amount-financed ceiling, a 36% APR cap, at least a six-month term and a supervised lender licensing requirement.
- Question 2Can a Colorado payday loan be due in two weeks?
- Answer
The current statute sets a minimum term of six months. A two-week advertisement does not describe a Colorado-compliant deferred deposit loan and requires product and creditor verification.
- Question 3How long does the cancellation right last?
- Answer
The consumer may rescind on or before 5 p.m. of the next business day after the transaction. Follow the written instructions and retain evidence that proceeds were returned and the authorization canceled.
- Question 4Does a matching service hold the Colorado license?
- Answer
Not necessarily. The website receiving the request may only be an arranger or lead generator. Verify the actual creditor and every relevant entity in the Consumer Credit Unit license report.
- Question 5Where can a Colorado lending complaint be filed?
- Answer
The Colorado Attorney General Consumer Credit Unit accepts credit and debt complaints and investigates regulated lenders and creditors. Include dates, amounts, the legal company name, website, agreement and communications.
