Connecticut payday-loan rules: the direct answer
Traditional high-cost payday lending is not a lawful unlicensed product in Connecticut. The Department of Banking treats payday companies as unlicensed small-loan lenders and noncompliant loans as potentially void and unenforceable. A licensed or exempt entity may still offer a regulated small loan within state limits.
A small loan under $5,000 cannot exceed the lesser of 36 percent APR or the maximum for covered credit under the federal Military Lending Act. The broad definition includes credit or an advance against future money when the amount is $50,000 or less and APR exceeds 12 percent.
Offer cards on this page are reviews of national connection services, not approvals of Connecticut payday lenders. A matching response is useful only after the legal creditor, every broker or lead generator, applicable exemption, license and complete all-in APR have been identified from current records and the final agreement.
Which loans fall under Connecticut’s small-loan law
Section 36a-555 covers a loan, credit extension, purchase of or advance against future money when its amount does not exceed $50,000 and APR is above 12 percent. Future money includes pay, salary, pension and tax-refund proceeds. This functional definition matters more than labels such as cash advance, payday alternative, line of credit or financial-membership benefit.
Specified exclusions include residential mortgages, business-purpose credit, qualifying retail installment contracts and certain credit-card accounts issued by exempt entities. The exclusion must fit the transaction. A website cannot transform household credit into a commercial loan merely by adding a business-purpose checkbox.
Small loans below $5,000 face the 36 percent all-in ceiling. Loans from $5,000 through $50,000 generally face a 25 percent APR ceiling under the same section. Those larger-loan rules do not allow a payday service to split one need into multiple contracts, disguise mandatory costs or describe a broker fee as unrelated to obtaining credit.
Why Connecticut’s APR includes fees and memberships
Connecticut calculates APR using the federal Military Lending Act framework and requires each finance charge to be included. The current definition reaches charges for ancillary products, memberships or services sold with the small loan, amounts offered or agreed to as compensation for credit, and fees connected or concurrent with the transaction.
That approach blocks a common evasion pattern: advertising a low interest rate while shifting the economic price into an expedited-funding fee, subscription, optional-looking tip or required service package. Ask whether declining the charge changes approval, amount, speed or access. If payment is necessary to obtain the advertised credit, it belongs in the cost analysis even when the interface calls it voluntary.
Compare the amount deposited with every dollar paid to the lender, platform and connected service. The disclosed APR should reconcile with those cash flows. A network range or calculator is not controlling when the creditor deducts a fee, changes the schedule or adds a recurring charge.
Interest, connected fees and concurrent membership costs must be tested together. A small headline rate does not make an expensive required package compliant.
Connecticut cost examples at and above the ceiling
As a simple short-term illustration, $500 accruing at 36 percent annually for 14 days produces about $6.90 of interest using a 365-day calculation. A $75 charge for the same $500 and 14-day period represents a simple annualized rate near 391 percent. Actual APR follows the governing disclosure method, but the contrast shows why a traditional fee-heavy payday offer does not fit the state ceiling.
For an installment comparison, $600 amortized through four equal monthly payments at a 36 percent nominal annual rate produces payments of about $161.42. Scheduled repayment is approximately $645.66, including $45.66 of interest. These are neutral mathematical examples, not quotes; timing, rounding and included finance charges can change the final figures.
Run the creditor’s amount, frequency and charges through the appropriate calculator. Place each payment beside rent, food, utilities, transportation and a cash buffer. A compliant loan can remain unaffordable, especially when its first payment arrives before income recovers from the emergency.
Licensing reaches online lenders, brokers and lead generators
Section 36a-556 requires a license, unless exempt, to make, offer, solicit, broker, arrange or find a covered loan for a Connecticut borrower. It also reaches lead generation, receiving payments, acquiring loans and advertising these services online.
A regulated participant may not accept a Connecticut lead, referral or application from a party that is neither licensed nor exempt. This makes the first form in the chain relevant even when another business later supplies the agreement. Search NMLS Consumer Access and the Department of Banking’s current license list using legal entity names, trade names and NMLS identifiers.
Banks and credit unions can be exempt, but a nonbank does not inherit an exemption by naming a bank. Connecticut examines predominant economic interest, facilitation combined with purchase rights and the total circumstances when deciding whether an apparent agent is the lender in an evasion structure.
Contract terms Connecticut does not permit
A covered closed-end small loan cannot raise its interest rate because of payment default, use scheduled payments that fail to fully amortize principal, or create negative amortization. The law also rejects a prepayment penalty and an adjustable-rate provision. These protections matter independently from the numeric APR ceiling.
Review the amortization table instead of relying on the payment amount alone. Every regular payment should move the balance toward zero by the stated maturity. A balloon, unexplained residual balance or payment sequence that grows principal deserves clarification before signing, even if the first few debits appear affordable.
Connecticut also restricts class-action waivers and nonjudicial provisions that use inconsistent principles or limit borrower claims and defenses. An arbitration heading does not eliminate every protection. Preserve the contract and obtain legal advice when a dispute depends on forum or enforceability.
Void loans, debits and complaint evidence
A small loan inconsistent with statutory requirements is generally unenforceable and may be void as to principal, interest and charges, subject to bona-fide-error and relocation exceptions. That legal consequence is not permission to ignore correspondence or decide enforceability from a website summary.
Do not close an account or reverse a debit without understanding the underlying dispute. Contact the bank promptly about unauthorized transfers, send the creditor a written notice, and preserve delivery proof. Keep the advertisement, application path, agreement, payment authorization, statements, messages and names of each entity receiving data or money.
The Department of Banking accepts complaints about both licensed and unlicensed small-loan companies. Its payday-loan checklist asks for company information, documents and transaction details. The agency may investigate regulated conduct, but court papers and private claims still require timely personal attention.
Earned wage advances are a separate 2026 category
Connecticut updated its law for earned wage advances in October 2025. A qualifying provider remains subject to licensing and conduct rules, while that category uses a total finance-charge ceiling of $4 per advance or $30 per month instead of the ordinary APR cap.
A provider must offer at least one no-cost option per transaction and clearly explain how to select it. Other requirements address access, repayment and treatment of consumers. A product cannot claim this category merely because repayment is timed to payday; it must represent wages already earned and comply with the dedicated statutory definition and safeguards.
Compare no-cost delivery with paid options and calculate monthly use. Repeated express fees can become meaningful. If the service advances more than earned wages, uses recourse beyond the statutory structure or bundles credit, treat it as a possible small loan rather than assuming wage-advance rules apply.
Connecticut comparison checklist and alternatives
First ask the biller about a due-date adjustment, hardship plan or fee waiver. Compare a credit-union small-dollar loan, bank product, employer-paid advance and Connecticut 211 assistance. For an apparently unlicensed or overpriced transaction, use the Department of Banking’s secure process rather than sending account details through ordinary email.
- Identify the creditor, broker, lead generator, servicer and each company receiving a connected fee.
- Search the Connecticut license list and NMLS Consumer Access using the exact legal names.
- Recalculate APR with memberships, tips, expedited delivery and ancillary products included.
- Check the applicable 36% or 25% ceiling and confirm that scheduled payments fully amortize principal.
- Reject prepayment penalties, default-rate increases, negative amortization and unexplained balloon balances.
- Save the application path, disclosures, debit authorization, payment history and all communications.
Connecticut payday-loan FAQ
- Question 1Are payday loans legal in Connecticut?
- Answer
Traditional unlicensed high-cost payday loans are not enforceable lawful products. A licensed or exempt entity may offer a qualifying small loan that follows Connecticut’s all-in rate, licensing and contract requirements.
- Question 2What is the Connecticut payday-loan rate cap?
- Answer
A covered small loan below $5,000 generally cannot exceed the lesser of 36% APR or the applicable Military Lending Act maximum. Connected finance charges are included in that APR.
- Question 3Do online matching services need a Connecticut license?
- Answer
The statute reaches offering, brokering, arranging, finding and generating leads for covered loans unless an exemption applies. Verify the marketplace as well as the final creditor.
- Question 4Can a Connecticut small loan include a prepayment penalty?
- Answer
No. The covered contract restrictions prohibit prepayment penalties and also address default-rate increases, adjustable rates, incomplete amortization and growing principal balances.
- Question 5Where can an unlicensed lender be reported?
- Answer
The Connecticut Department of Banking accepts payday and small-loan complaints, including complaints about unlicensed companies dealing with Connecticut residents. Provide the agreement, advertisement, payment evidence and company identities.
