Georgia payday-loan rules: the direct answer
Payday lending is illegal in Georgia. The prohibition reaches beyond a storefront holding a postdated check: it covers making, offering, arranging or acting as an agent for loans of $3,000 or less through mail, telephone, electronic systems or the internet unless the provider fits a statutory exemption.
Georgia does permit licensed installment lenders to make regulated loans of $3,000 or less. These are not conventional two-week payday loans. They operate under the Georgia Installment Loan Act, which limits the contract term, interest and additional charges and requires a written repayment agreement.
Offer cards below describe matching and referral services, not verified Georgia payday lenders. A service may accept contact data even when no lawful payday product is available. Treat any response as unverified until the actual creditor, Georgia license or exemption, price, loan structure and payment schedule are confirmed.
What Georgia’s Payday Lending Act prohibits
The Act addresses a business conducted in any form that consists in whole or in part of making, offering or arranging loans of $3,000 or less. That functional wording prevents a company from avoiding the rule by calling itself a marketplace, agent, membership service or technology platform when it participates in an unlawful small-loan transaction.
Internet delivery and an out-of-state address do not excuse compliance. Georgia’s Department of Banking and Finance warns that companies located elsewhere, outside the United States or claiming tribal ownership can still be subject to state law. The Georgia Supreme Court has also held that an asserted tribal connection was not a defense for the reviewed online lending structure.
Licensed installment lenders and specified financial institutions can fall within exemptions, but the exemption belongs to the qualifying transaction. Ask which company makes the credit decision, funds the loan, sets the terms, owns the receivable and receives each charge.
The legal alternative: a licensed installment loan
The Department regulates consumer installment loans with a principal or advance of $3,000 or less. Unless exempt, the maker must hold a Georgia installment-lender license. The Department’s guidance states that a licensee may use a term of up to 36 months and 15 days and charge interest not exceeding 10% per year of the face amount of the contract.
The 10% figure is not necessarily the complete APR. The Act permits specifically controlled loan, maintenance, closing, convenience, late and insurance-related charges when their conditions are satisfied. Compare the cash actually delivered with every scheduled dollar rather than describing the offer as a 10% loan from the interest line alone.
A regulated lender may originate or close remotely, so “online” does not automatically mean prohibited. The meaningful distinction is whether the lender is licensed or exempt and the contract complies with the installment framework. Check NMLS Consumer Access using the legal and trade names shown in the agreement.
Georgia installment contracts can contain separately authorized charges. Use net proceeds, finance charge, payment schedule and total repayment to compare the complete cost.
Georgia cost examples and fee review
At 10% simple annual interest, $1,000 outstanding for one year produces $100 of interest before any separately permitted charge. A two-week $500 advance carrying a $75 fee, by contrast, requires $575 and represents a simple annualized rate near 391%. The contrast helps identify payday pricing but does not quote a lender or calculate formal APR.
For each installment offer, write down the face amount, actual cash advanced, prepaid charge, monthly maintenance amount, closing fee, optional insurance, electronic-payment charge, payment count and total of payments. A deducted fee reduces usable proceeds even though the contract balance remains larger, which can materially increase the effective price.
Georgia rules require maintenance charges to be separately itemized and refunded when unearned after early termination. A closing fee requires an actual credit, residence, reference, employment or income investigation or verification. Convenience fees must relate to receiving or remitting an electronic payment under their authorizing rule.
Contract and repayment protections
Every regulated consumer loan must use a completed written contract delivered when signed. Its itemized statement must identify the parties, transaction, collateral, actual cash advanced, insurance, interest, fees and other charges. It must also provide the maximum number and amount of payments and their exact due dates.
Do not sign blank spaces. The required consumer notice explains the right to receive copies and to prepay, with a possible partial refund of interest under applicable conditions. Optional items or services introduced at the consumer’s expense require a separate disclosure stating that they are not required and showing their specific cost.
Except for a single-payment loan, installments generally must be equal and regularly scheduled; the final payment cannot exceed another by more than $1. A permitted single-payment installment loan may not exceed 90 days. These rules do not revive a high-fee payday arrangement by changing its label.
Late charges, servicing errors and collection
A licensed installment lender may assess a late charge only after an installment remains unpaid for more than five days. The allowed amount is $10 or 5% of that installment, whichever is greater, and it cannot be collected more than once for the same default. An unearned late charge cannot be collected in advance.
Current servicing rules prohibit fees for handling disputes, routine collection, arranging a repayment plan, sending a nonpayment notice or updating records to reinstate a loan. A servicer must acknowledge a qualifying written notice of error within 10 business days and provide a correction or reasoned determination within 45 days after investigation.
Earned-wage advances require a separate classification
A 2024 unofficial Georgia Attorney General opinion considered a narrow earned-wage-access model. It concluded that an optional, flat, one-time instant-transfer fee generally would not be interest when it compensates a real transfer service rather than the time value of money and the wage advance is nonrecourse.
That opinion is not a blanket approval of every pay-advance app. The fee must be adequately and reasonably justified, and charges for nonexistent services can be treated as interest. Recourse, repeated debit attempts, mandatory speed fees, time-based pricing or access conditioned on payment can change the analysis.
Ask whether free delivery is usable, whether tips change eligibility, whether the provider can collect after a failed payroll deduction and whether the amount represents wages already earned. Preserve the complete fee-selection screen and agreement. A payday-style repayment date and charge should not be assumed lawful because the interface uses wage terminology.
Void loans and how to document a complaint
Georgia DBF states that a loan under $3,000 made by an entity required to hold an installment license but lacking one is void. For a prohibited payday loan, the lender has no right to collect, receive or retain principal, finance charges or other fees, and the statute also permits a borrower civil action in specified circumstances.
Those consequences do not justify ignoring a lawsuit, concealing collateral or making an unsupported stop-payment decision. Obtain transaction-specific legal advice. Contact the bank promptly about unauthorized debits, send a traceable written dispute and preserve copies of every notice, payment and response.
Report suspected payday lending to the county solicitor or district attorney and notify the Department of Banking and Finance. The Attorney General’s Consumer Protection Division also accepts complaints. Include the advertisement, application path, agreement, license search, funding proof, bank statements, ledger, debit authorization and identities of all participating companies.
Georgia offer-comparison checklist and alternatives
Ask the biller first about a due-date change, hardship plan or waived penalty. Compare a bank or credit-union small-dollar loan, employer assistance, nonprofit counseling and Georgia 211 resources. Test the exact schedule with the repayment-budget calculator so housing, utilities, food and transportation remain covered.
- Identify the creditor, broker, lead generator, servicer and every entity receiving data or payment.
- Verify the exact lender name and NMLS identifier through Georgia DBF resources and NMLS Consumer Access.
- Reject an unlicensed payday structure even if the provider is online, out of state or claims tribal affiliation.
- Compare actual cash advanced, interest, every itemized fee, payment dates, collateral and total repayment.
- Check optional products, prepayment refunds, late-charge timing, error-resolution rights and debit instructions.
- Save the advertisement, signed contract, disclosures, license result, receipts and all servicing communications.
Georgia payday-loan FAQ
- Question 1Are payday loans legal in Georgia?
- Answer
No. Conventional payday lending is illegal. A licensed or exempt provider may instead offer a loan of $3,000 or less that complies with the Georgia Installment Loan Act and applicable rules.
- Question 2Can an online lender make a payday loan to a Georgia resident?
- Answer
Internet delivery does not avoid Georgia law. An online provider must fit a valid exemption or hold the required installment-lender authority and offer a compliant product.
- Question 3What is the interest limit for a licensed Georgia installment loan?
- Answer
DBF guidance states that interest may not exceed 10% annually of the contract’s face amount. Separately authorized charges can affect the complete APR and total repayment.
- Question 4Is an unlicensed Georgia small loan enforceable?
- Answer
DBF states that a sub-$3,000 loan made by an entity required to be licensed but lacking a license is void. Payday-loan collection is separately prohibited. Obtain legal advice for a specific contract.
- Question 5Where can illegal payday lending be reported in Georgia?
- Answer
Notify the Georgia Department of Banking and Finance and the Attorney General’s Consumer Protection Division. The state also directs victims to their county solicitor or district attorney.
