Iowa payday-loan rules: the direct answer
Iowa permits licensed delayed deposit transactions under Iowa Code Chapter 533D. A licensee may hold no more than two checks from one maker, their combined face amount cannot exceed $500, and no check may be held longer than thirty-one days. The $500 figure describes the check or checks promised for repayment, not necessarily the cash placed in the borrower’s hands.
The maximum service fee is $15 on the first $100 of check face value and $10 on each additional $100, prorated for a partial increment. A $500 check can therefore carry a $55 fee and provide $445 in cash. The written notice must identify the fee, federal Truth in Lending Act APR, presentment date and any permitted dishonored-check penalty.
Offer cards on this page describe national matching or referral services, not Iowa-licensed payday lenders. A successful form submission does not prove that the eventual creditor operates a Chapter 533D business, is physically located and licensed in Iowa, or offers terms within these limits.
What counts as delayed deposit services
Chapter 533D covers a business that accepts a postdated check for a fee or accepts a currently dated check and agrees to wait before depositing or presenting it. The traditional transaction therefore combines an immediate cash payment with the lender’s promise to hold a repayment instrument until an agreed date.
Banks, savings and loan associations, credit unions, industrial loan companies and qualifying affiliates are excluded from Chapter 533D. An exemption from this chapter does not erase the laws applicable to that institution or make a marketing intermediary the lender.
$500 face-amount ceiling and two-check limit
The licensee cannot hold more than two checks from one maker at once. Those checks cannot have an aggregate face amount above $500. The restriction also reaches businesses under common ownership or control, entities in which the licensee has a financial interest, and the licensee’s employees or agents; splitting checks between related storefronts does not create another allowance.
Face amount is the sum payable when the check is presented. If the maximum fee is deducted from proceeds, a $200 check provides $175 and later requires $200; a $350 check provides $310 after a $40 fee; and a $500 check provides $445 after a $55 fee. Read the contract to confirm whether the quoted number describes the check, amount financed, proceeds or payoff.
Fee formula, payoff and estimated APR
Calculate the ceiling marginally: charge no more than $15 for the first $100 of face amount, then $10 per $100 above it, with proportional treatment of a final fraction. A $250 check has a $30 maximum fee—$15 plus $10 plus $5—and supplies $220 when that fee is withheld.
For a hypothetical $500 check held fourteen days, $445 of proceeds and a $55 finance charge produce a simple annualized estimate of about 322%. At thirty-one days, the same figures produce about 146%. These are educational estimates, not substitutes for the TILA APR that the licensee must disclose using the actual amount financed, fee and timing.
A legal fee ceiling is not an affordability measure. Compare usable proceeds, finance charge, exact days, APR, face amount to be paid and the income remaining after essentials. Chapter 533D also prohibits other charges beyond the authorized transaction fee and disclosed single dishonored-check penalty.
The statute caps aggregate check face amount at $500. At the maximum fee, the common cash-flow illustration is $445 received and $500 presented—not $500 received and $555 presented.
Term, written notice and funding method
A licensee cannot hold or agree to hold a check longer than thirty-one days. Chapter 533D does not specify a general minimum holding period. The disclosure should use a calendar date for deposit or presentment, allowing the borrower to compare the promised timing with payroll and bank-processing days.
At the transaction, the maker must receive clear, understandable notice of the dollar fee, APR, presentment date and any returned-check penalty. Every licensed office must also conspicuously display its schedule of fees, charges and penalties. Save the notice before leaving a storefront or completing an electronic workflow.
Renewals and Iowa’s same-day transaction rule
A licensee cannot repay, refinance or otherwise consolidate a postdated-check transaction with proceeds of another postdated-check transaction made by that licensee. Paying another fee merely to postpone the same obligation should not be described as a routine rollover.
Current Banking Division rule 187—17.13 addresses a new transaction on the same day an existing one is paid. It permits that sequence only when the checks being paid plus the new check do not exceed the $500 statutory maximum and the licensee does not count more than two checks in the maker’s name, including the old and new instruments.
The rule is easier to apply with a timeline. Record each check’s face amount, origination date, payoff date, fee and replacement check. Unlike several other states, the cited Iowa delayed-deposit provisions do not provide a generally available statutory extended payment plan, so a voluntary arrangement should be obtained in writing before default.
Returned checks and collection protections
The disclosed penalty for a check that is not negotiable on the agreed date cannot exceed $15. It may be collected only once on that check regardless of how long the item remains unpaid. If the licensee charges it, the statute describes that penalty as the licensee’s exclusive remedy and bars layering other Chapter 533D penalties onto the same event.
A returned check does not authorize false arrest threats, accusations of a crime, harassment or misrepresentation of the debt. Iowa’s Debt Collection Practices Act expressly includes a check from a Chapter 533D transaction in its definition of debt and restricts illegal threats, abusive communications and unauthorized incidental charges.
What Iowa examination data shows
The Division’s published 2023 examination survey reviewed 14,957 transactions across 1,300 customer histories. In that sample, the average amount financed was $369.77, the average finance charge was $46.60, the average term was 18.92 days and the average APR was 249.79%. These are historical examination observations, not a current quote or forecast.
The same sample recorded an average 11.51 loans per customer during the reviewed year, and 52.62% of customer histories had twelve or more transactions. The results do not represent every Iowa resident, but they show why a one-transaction fee comparison is incomplete when reborrowing becomes a pattern.
Licensing, online offers and complaints
A person generally cannot operate a Chapter 533D delayed deposit business in Iowa unless physically located in the state and licensed by the Superintendent of Banking. The license must be displayed at its approved business location. Use NMLS Consumer Access through Iowa Division of Banking and search the exact legal name from the agreement.
An online lender outside Iowa may claim a bank relationship, exemption or different product. Do not decide validity from the domain alone. Obtain the creditor’s legal name, NMLS identifier when applicable, governing product, Iowa authority, amount financed, complete fee, APR, due date and debit authorization.
IDOB asks consumers to contact the business first, identify the proper regulator and then submit its complaint form. A regulated bank or licensee normally receives ten to twenty business days to research and respond. Preserve copies and redact sensitive identifiers that are unnecessary to explain the dispute.
Iowa offer checklist and alternatives
Ask the biller about a due-date change or hardship schedule. Compare a bank or credit-union small-dollar product, employer assistance, utility relief and nonprofit counseling. Use the repayment-budget calculator with actual cash received and the check face amount due; the statutory ceiling is not a recommended borrowing target.
- Identify the legal lender, referral service, servicer and every recipient of application data.
- Verify the exact company and delayed-deposit authority through Iowa Division of Banking and NMLS.
- Distinguish cash proceeds, amount financed, fee, check face amount and total payoff.
- Confirm no more than two checks, no more than $500 aggregate face value and no term above thirty-one days.
- Record the APR, presentment date, same-day transaction history and one-time returned-check penalty.
- Save disclosures, checks, receipts, debit permissions, bank records and complaint correspondence.
Iowa payday-loan FAQ
- Question 1Are payday loans legal in Iowa?
- Answer
Yes. Iowa licenses delayed deposit services under Iowa Code Chapter 533D, subject to check, fee, term, disclosure and business-location requirements.
- Question 2What is the Iowa payday-loan limit?
- Answer
A licensee may hold no more than two checks from one maker with a combined face amount no greater than $500. Because the fee is commonly withheld, $500 of check face value can mean less than $500 in cash proceeds.
- Question 3What is the maximum fee on a $500 Iowa delayed deposit check?
- Answer
The maximum is $55: $15 on the first $100 and $10 on each of the next four $100 increments. That commonly produces $445 in cash against a $500 check.
- Question 4How long can an Iowa payday lender hold a check?
- Answer
No longer than thirty-one days. The written notice must state the date the check will be deposited or presented.
- Question 5Can an Iowa lender charge repeatedly for one returned check?
- Answer
The disclosed returned-check penalty cannot exceed $15 and may be collected only once on that check, regardless of how long it remains unpaid.
