Kentucky payday-loan rules: the direct answer

Kentucky permits licensed deferred deposit transactions under KRS Chapter 286.9. For transactions entered on or after July 15, 2026, one customer may have no more than two open transactions across licensees and may receive no more than $600 in total proceeds from all of them. The former $500 figure is no longer the current statutory starting amount.

The service fee cannot exceed $15 per $100 of the deferred deposit check’s face amount and must be prorated for a partial increment. That fee covers a period of at least fourteen days, while a licensee cannot agree to hold the payment instrument longer than sixty days. Kentucky also uses a real-time statewide database to test eligibility.

Offer cards on this page are national matching or referral services with published reviews. They do not establish that the respondent is a Kentucky deferred deposit licensee or that the product fits this law. Obtain the legal provider name, agreement and product category before treating any response as a Kentucky payday-loan offer.

What a deferred deposit transaction means

Kentucky defines the transaction by accepting a payment instrument for consideration and agreeing to hold it before deposit or presentment. Payment instrument includes a check, draft, money order or traveler’s check. The maturity date is when that instrument may be redeemed or presented for payment.

A Kentucky citizen may sign the dated agreement in person, by telephone or through other electronic means, but the agreement method does not erase the payment-instrument structure. DFI guidance says an electronic payment cannot substitute for the hardcopy instrument needed to originate a deferred deposit transaction. A purely online installment loan therefore requires a different license and legal analysis.

The July 2026 limit and future adjustments

Senate Bill 219 became 2026 Kentucky Acts Chapter 98 and changed the proceeds ceiling effective July 15, 2026. The current base amount is $600 across all open transactions, not $600 from each licensee. The amendment applies to transactions entered on or after its effective date.

The commissioner must issue an order by July 1 each year increasing or decreasing that ceiling by the prior calendar year’s nonseasonally adjusted annual-average CPI-U percentage, rounded up to the nearest $10. No order may produce an amount above $850. Because the figure can change, a future visitor should verify the latest DFI order instead of relying indefinitely on this page title.

The same 2026 law sets a $3 database fee for each submitted transaction and permits that fee to be charged to the customer. It is distinct from the statutory service-fee calculation. The written cost comparison should therefore show proceeds, service fee, database fee, check face amount and total payment rather than one unexplained number.

Current Kentucky ceiling

As of August 27, 2026, total proceeds from all open deferred deposit transactions cannot exceed $600. The commissioner can adjust this amount annually, subject to an $850 statutory maximum.

Face amount, cash proceeds, fees and APR

Kentucky uses two different bases. The $600 eligibility ceiling measures proceeds the customer receives, while the 15% service-fee ceiling is calculated from the payment instrument’s face amount. Do not automatically add $90 to $600 or assume the advertised amount is the check amount; read how the provider structures the transaction.

A simplified discount illustration starts with a $100 check face amount. The maximum service fee is $15, leaving $85 in cash proceeds if the fee is withheld, and the check is later presented for $100. Over fourteen days, $15 divided by $85 and annualized is approximately 460%. The actual federal Truth in Lending disclosure controls because exact proceeds, charges, dates and the $3 database fee can change the result.

Fourteen-day fee period and sixty-day ceiling

The maximum service fee is for a period of at least fourteen days. Separately, the licensee cannot agree to hold the transaction for more than sixty days. The written agreement should state a calendar maturity date, not only “next payday,” so weekends, holidays and bank-processing timing are visible.

Two open transactions and the statewide database

Before entering a transaction, a licensee must query the Kentucky Deferred Presentment Transaction System through a real-time connection. The result checks open transactions across participating licensees. A customer with two open transactions is ineligible for another, and combined proceeds cannot exceed the current $600 ceiling.

The database receives identifying data, the licensee and location, transaction amount and dates. Its answer to a licensee states eligibility or ineligibility and the reason. The customer may directly request a more detailed explanation of the transaction that caused an ineligible result; transaction history is otherwise confidential and excluded from ordinary public inspection.

Agreement, disclosures and prohibited security

Every transaction requires a dated written or electronic agreement signed by the customer and licensee or authorized agent, and the customer must receive a copy. The licensee must provide federal Consumer Credit Protection Act disclosures in writing and conspicuously display its schedule of authorized fees and charges at each licensed location.

The licensee cannot require collateral or another person’s guaranty for a deferred deposit transaction. It also cannot use unfair or deceptive acts, practices or advertising, or employ an affiliate arrangement designed to collect more than the authorized charges. Save the offer screen and final agreement if the numbers or company identity change during the process.

Rollovers and fee-based consolidation are prohibited

A licensee and its affiliate cannot charge a fee to renew, roll over or otherwise consolidate a deferred deposit transaction. Changing a due date, replacing an instrument or moving the obligation to an affiliated name should not silently create another service fee.

Dishonored checks and collection protections

KRS 286.9-102 allows a licensee to pass through check-collection charges made by a financial institution for a returned or dishonored check only when the terms were disclosed in advance. This is not permission to invent an unlimited recurring penalty. Compare the bank-originated charge with the exact contract language and account record.

A 2026 amendment clarifies that a licensee may continue lawful collection when the database has marked a transaction closed but the payment instrument remains unpaid because it was returned or dishonored. Those efforts must comply with state and federal collection law, cannot become a renewal or rollover and do not create another database transaction.

The customer cannot be convicted under Kentucky’s cold-check provision merely for entering the deferred deposit transaction, and the licensee cannot prosecute or threaten prosecution under KRS 514.040. Preserve messages and report a criminal threat rather than treating it as ordinary collection language.

License checks and void unlicensed agreements

A business generally needs a Kentucky license before accepting deferred deposit transactions for a fee, with a separate license for each location. Search DFI’s Depository and Non-Depository database using the exact legal name, location and trade name from the agreement. Also review DFI’s current deferred-deposit enforcement actions.

KRS 286.9-035 gives licensing unusual importance: an agreement made with an unlicensed person is void, and that person cannot collect principal, fees, interest or other recompense. The commissioner may also void an agreement after a licensee’s statutory violation, while allowing recovery of principal but not the related service fee or charge.

How to file a Kentucky complaint

Kentucky DFI regulates check cashers and deferred deposit companies and provides an electronic financial-institutions complaint form. Identify the company, location, dates, proceeds, fees, database result, payment instrument, collection contact and the resolution already requested. Attach readable copies while retaining originals.

Kentucky offer checklist and alternatives

Ask a biller about a due-date change or hardship schedule before using high-cost credit. Compare a bank or credit-union small-dollar product, employer assistance, utility relief and nonprofit counseling. Use the loan-cost calculator with net proceeds rather than the headline amount, then test the payment against the budget remaining after essentials.

  1. Identify the referral service, licensed location, legal provider, servicer and every recipient of application data.
  2. Verify the exact deferred deposit license and location in the Kentucky DFI database.
  3. Confirm no more than two open transactions and no more than $600 in combined proceeds at the current ceiling.
  4. Separate proceeds, check face amount, service fee, $3 database fee, APR and total payment.
  5. Record the maturity date, rollover prohibition, dishonored-check terms and all debit permissions.
  6. Save the signed agreement, disclosures, payment instrument, receipts, database correspondence and complaint records.
