Minnesota payday-loan rules: the direct answer

Minnesota regulates payday borrowing through two related categories: a consumer small loan and a consumer short-term loan. The Department of Commerce says the 2024 reforms changed both products and calls the combined ceiling an all-in annual percentage rate (APR). For loans originated under the current rules, interest, finance charges and fees generally cannot push the APR above 50%. A lender must also complete an ability-to-repay analysis when the APR is above 36%.

A consumer small loan is an unsecured, single-payment loan of $350 or less, with a term of no more than 30 calendar days. A consumer short-term loan can be up to $1,300 when more than 25% of the principal or credit advance is due within 60 days. The statutes limit additional charges and require a written contract. The company making or arranging either product must hold the appropriate Minnesota authorization unless a statutory financial-institution exception applies.

The offer cards below are national matching and referral services with separate reviews. Their forms do not prove that a Minnesota-licensed lender will receive an application or that a displayed amount is a legal Minnesota product. Identify the actual lender, amount financed, all-in APR, payment date, ability-to-repay process and debit permissions before sending sensitive information.

Consumer small loans versus consumer short-term loans

Section 47.60 covers the classic payday-style consumer small loan: cash for a personal, family or household purpose, up to $350, repaid in one installment. Current law allows an all-in APR of up to 50% and no other lender charges except items specifically authorized by the statute, such as a permitted returned-check charge. The term cannot exceed 30 days, and the same borrower cannot have the transaction split to evade the $350 limit or repay one loan with another from the same lender or related interest.

Section 47.601 covers a broader consumer short-term loan up to $1,300 when a substantial payment is due within 60 days. The contract must identify the lender’s legal name, street address and phone number, list fees and interest, show the APR in bold 24-point type and describe the payment obligation. The statute also voids a clause that selects another state’s law, another forum or a class-action waiver for covered violations. Read the product definition instead of assuming that a “personal loan” label avoids payday rules.

The 50% all-in APR ceiling and ability-to-repay review

Minnesota’s current APR definition includes interest, finance charges and fees. The Commerce Department’s legislative summary gives a useful illustration: on a $400, fourteen-day loan, an all-in 36% ceiling produces roughly $6 in permitted charges, while an all-in 50% ceiling produces roughly $8. The dollar result depends on the exact dates and calculation method, but a short term makes a modest-looking fee expensive when annualized.

For any payday loan above 36% APR, section 47.603 requires the lender to document net income, housing and other major obligations, existing debt and basic living expenses. The lender must determine that the borrower can pay the loan at maturity and still meet those obligations and essential expenses through the period ending 30 days after repayment. A request for pay stubs or a credit report should be connected to this analysis, not used as a substitute for a clear contract.

Minnesota cost check

Ask whether the quote is a $350 consumer small loan or a $1,300 consumer short-term loan. Compare the all-in APR, total charges, payment date and net proceeds; do not compare a fee in isolation.

Online transactions, lead generators and no-evasion rules

Minnesota treats an electronic consumer small loan as covered even when the company has no physical Minnesota office. For a consumer short-term loan, the transaction is deemed to occur in Minnesota when a Minnesota resident completes it electronically or in person while physically located in the state. An out-of-state address does not, by itself, select a different rulebook.

The statutes expressly address arranging and evasion. Facilitating, marketing, generating leads, underwriting, servicing or collecting can bring a participant within the consumer short-term lender definition. A person cannot disguise loan proceeds as a sale, a rebate or a service contract to avoid the APR and licensing requirements. Ask which entity owns the economic interest, funds the advance, buys the receivable and receives each fee.

Contract disclosures, payment timing and repeat borrowing

Keep the complete written contract before authorizing a payment. For a covered short-term loan, check the legal lender’s street address, signer, itemized charges, bold APR and payment schedule. For a small loan, request the approved charge schedule and a copy of the agreement. Compare the principal with the cash deposited, then include every required fee in the total repayment calculation.

A new application is not a cost-free extension. Section 47.60 bars using a new small loan from the same lender or related interest to repay the earlier one, while the short-term provisions prohibit terms that evade the statutory ceiling. Put each due date beside rent, utilities, food, transportation and existing debt. A payment that technically fits a lender’s screen may still leave no safe cash buffer.

Commerce licensing and the official license lookup

The Minnesota Department of Commerce licenses or registers consumer small-loan lenders and regulated lenders. Its payday-lender page says a business making small loans to Minnesota residents must be licensed and may not need a physical Minnesota location. The Department uses the Nationwide Multistate Licensing System for applications, while its License Lookup Directory includes a Consumer Small Loan Lenders category.

Search the exact legal name, trade name, address and license number printed in the agreement. A referral brand, a “partner lender” badge or a registration in another state is not enough. Save the search result with the date checked. If a company will not identify the creditor, requests an upfront verification fee or asks for online-banking credentials, pause and contact Commerce before proceeding.

Violations, void loans and debt collection

Section 47.601 provides strong remedies for a covered short-term loan made without a required license, with prohibited terms, without the required ability-to-repay compliance or above the permitted charges. The loan can be void, the borrower can avoid amounts owing, and the statute allows recovery of money collected, actual and consequential damages, up to $1,000 in statutory damages per violation, attorney fees and injunctive relief. A fact-specific review is still necessary before disputing a balance.

If a collector contacts you, request the legal creditor, account history and written payoff. Keep messages, bank statements, the application, contract and proof of each debit. Minnesota debt collectors must provide a written list of Minnesota-based nonprofit credit-counseling organizations. Do not ignore a court paper; instead, bring the records to a qualified adviser and ask Commerce about its complaint process.

Minnesota verification and lower-cost alternatives

The Borrow Radar calculators can model the proposed payment and the cash left after essentials, but they do not determine legality or approval. If the payment would consume the next paycheck, request more time from the creditor or use a community resource first. A lender that cannot explain its category, license, total price and maturity date in one complete document has not supplied enough information to make a careful decision.

  1. Record the marketplace, legal lender, servicer, license number, street address and every company named in the privacy or payment consent.
  2. Use the Minnesota Commerce License Lookup and confirm whether the entity is authorized as a consumer small-loan lender, regulated lender or another relevant category.
  3. Classify the offer as a $350 consumer small loan or a $1,300 consumer short-term loan, then calculate the all-in APR and total charges.
  4. Check the contract for the bold APR, itemized fees, payment date, Minnesota-law language, ability-to-repay questions and debit authorization.
  5. Save the offer, contract, privacy notice, credit-report consent, income documents, payment receipts and any collection messages.
  6. Ask a biller, employer, bank, credit union or nonprofit counselor about a hardship arrangement or lower-cost alternative before accepting a short-term debit.

Minnesota payday-loan FAQ

Question 1What is the maximum payday-loan amount in Minnesota?
Answer

A consumer small loan is $350 or less. A consumer short-term loan can be up to $1,300 when more than 25% of the principal or credit advance is due within 60 days. The product definition and contract terms determine which statute applies.

Question 2What APR can a Minnesota payday lender charge?
Answer

Current Minnesota law uses an all-in APR ceiling of up to 50% for covered consumer small and short-term loans. Loans above 36% APR also require an ability-to-repay analysis, and no other charges are allowed on a covered short-term loan.

Question 3Does Minnesota require an ability-to-repay check?
Answer

Yes. For a payday loan above 36% APR, the lender must document net income, major obligations and basic living expenses and determine that the borrower can pay at maturity while meeting those costs through 30 days after repayment.

Question 4Can an online lender outside Minnesota use another state’s law?
Answer

Minnesota treats covered electronic transactions with Minnesota residents as occurring in Minnesota and prohibits evasion by mail, phone or Internet. Verify the lender’s Minnesota authorization and the contract’s Minnesota-law terms.

Question 5Where can I report a Minnesota payday-loan problem?
Answer

Contact the Minnesota Department of Commerce Consumer Services Center at 651-539-1600 or 800-657-3602, or use its online complaint portal. Include the legal company, timeline, contract, payments and requested resolution.
