Mississippi payday-loan rules: the direct answer

Mississippi permits a licensed delayed-deposit transaction under the Mississippi Check Cashers Act. The borrower writes a personal check, receives less than the check face amount in cash, and agrees that the licensee may deposit or collect the check on a stated date. The Mississippi Department of Banking and Consumer Finance (DBCF) requires a written agreement, an annual percentage rate (APR) disclosure and a consumer-education pamphlet before the transaction is signed.

The legal ceiling is expressed through the check face amount, not just the cash placed in the borrower’s hand. A delayed-deposit check cannot exceed $500 including fees, and a customer’s aggregate outstanding amount cannot exceed $500 including fees. Because the fee is included in that ceiling, the practical cash advance is lower: the DBCF pamphlet illustrates a $410 advance paired with a $500 check and a $90 fee. A lender’s advertisement that shows only a headline amount is incomplete without this distinction.

The reviewed offer cards below are national matching or referral services. Their presence does not establish that a Mississippi-licensed creditor will receive an application, offer a delayed-deposit product or use Mississippi pricing. Before sharing bank details, identify the actual creditor, legal product, total fee, APR, payment date and debit authority in the final agreement.

Amount, term and how the fee is calculated

For a personal check with a face amount of $250 or less, a licensee may delay deposit for up to 30 days. A check with a face amount above $250 and no more than $500 must have a written delayed-deposit agreement lasting at least 28 days and no more than 30 days, with the customer choosing the period. The agreement should state the transaction date, maturity date, check number, amount advanced and amount to be collected.

The maximum delayed-deposit fee is $20 per $100 advanced for a check face amount of $250 or less. For a check face amount above $250 and up to $500, the ceiling is $21.95 per $100 advanced. The statute also says the check, including the fee, cannot exceed $500. For example, the DBCF regulation lists $300 advanced, a $65.85 fee and a $365.85 face amount; $400 advanced produces an $87.80 fee and a $487.80 face amount. These examples make clear why comparing the cash advance alone can understate the payoff.

Mississippi requires the fee to be displayed as a dollar amount and as an APR in the written agreement. The regulation’s example of $100 advanced for 14 days with a $20 fee produces an annualized APR above 500%. That annualized number is not a prediction of the amount due; it is a way to expose the cost of a short period. Compare net proceeds, the exact fee and the face amount together.

Mississippi cost check

Ask for three numbers before accepting: cash advanced, total fee and check face amount. Confirm that the face amount includes every fee and stays within the $500 customer ceiling.

No fee-only rollover or replacement check

Mississippi law prohibits renewing or extending a delayed-deposit check and prohibits paying one check with the proceeds of another check from the same licensee or an affiliate. A request to “just pay the fee” is therefore not a routine renewal. The original check must be deposited or paid in full before a new delayed-deposit transaction can be entered. The DBCF consumer pamphlet warns that repeatedly using another payday loan can deepen the shortfall rather than solve it.

A returned check does not automatically authorize a stack of collection fees. The Act bars a late fee or collection fee for default, while a processing fee may be charged only when authorized in the written agreement and within the commissioner’s limit. The DBCF check-casher regulation sets that processing fee at no more than $30, one time for the returned check regardless of how often it is processed. Request an itemized account history if the amount claimed is higher.

Default, payment plans and collection conduct

A licensee may agree to a payment plan after default, but Mississippi’s regulation does not make a plan automatic. If the licensee accepts a plan and the borrower later defaults under that plan, the licensee may cash the original check but may not collect more than the original check amount plus the permitted processing fee. Get any plan in writing with each installment, due date, balance and consequence of a missed payment.

The DBCF pamphlet also states that a lender cannot threaten criminal prosecution to collect a payday loan. A lender may pursue a civil action and may seek court-awarded costs or fees where the law permits, but an empty threat of arrest is a serious warning sign. Save voicemails, text messages, emails, bank records and the signed agreement. Never send original documents to a collector or regulator.

DBCF licensing and checking the legal company

The DBCF regulates check cashers and other nonbank consumer-finance businesses operating in Mississippi. Its current website publishes a Check Cashers Act licensee list with legal company names and licensed locations. A storefront brand, lead form or national marketplace is not the same thing as the creditor listed in a contract. Search the exact legal name and address, then ask which licensed entity owns the receivable and controls the payment authorization.

The Act requires a valid license for a person portraying itself as a check casher, including electronic advertising. It also prohibits false, misleading or deceptive advertising. If a website promises guaranteed approval, hides the fee until after a bank-account connection or will not provide a Mississippi address and complaint contact, pause the application. A license-list match is a starting point, not proof that a particular online offer complies with every term.

Online applications, data sharing and offer matching

An online form can be a lead-generation step rather than a loan application to the company whose logo appears on the page. Read the privacy notice for names of marketing partners, credit-report providers, bank-account connection tools and recurring-debit vendors. Record the URL, timestamp, consent checkboxes and any range shown before submitting. The final creditor must still disclose the Mississippi fee, APR, maturity date and check or electronic-payment authorization in a complete agreement.

Do not treat the number of lenders in a marketplace as the number of suitable Mississippi options. A comparison profile can link to a full review, but availability remains a question for the matched lender. If the service asks for an upfront “insurance,” “verification” or “release” payment, stop. Legitimate costs should be stated in the credit agreement, not demanded before a lender is identified.

A practical Mississippi verification checklist

Borrow Radar calculators can show the annualized cost and the cash left after essential expenses, but they do not approve a loan or decide whether a fee is legal. Use the calculations as a conversation starter with a creditor or counselor. If a company cannot explain the creditor, total price and payment date in plain language, there is not enough information to authorize a check or electronic debit.

  1. Write down the marketplace, matched creditor, servicer, legal address, license information and every party named in the privacy or ACH consent.
  2. Classify the proposal as a Mississippi delayed-deposit transaction and check the cash advance, fee, check face amount, APR and 28-to-30-day or up-to-30-day maturity rule.
  3. Confirm that the total face amount and your aggregate outstanding amount, including fees, remain at or below $500.
  4. Read the returned-check clause: no fee-only rollover, no replacement check from the same licensee or affiliate, and no more than one authorized processing fee.
  5. Keep the signed agreement, consumer pamphlet, screenshots, bank statement, payment receipts and every collection message in one folder.
  6. If repayment will consume rent, utilities, food or transportation money, ask the biller, employer, bank, credit union or nonprofit counselor for a hardship arrangement before accepting the debit.

Mississippi payday-loan FAQ

Question 1What is the maximum payday-loan amount in Mississippi?
Answer

A delayed-deposit check cannot exceed $500 including fees, and a customer’s total outstanding amount cannot exceed $500 including fees. The practical cash advance is lower because the fee is included in the check face amount.

Question 2How much can a Mississippi payday lender charge?
Answer

The maximum is $20 per $100 advanced for a check face amount of $250 or less, or $21.95 per $100 advanced when the face amount is above $250 and up to $500. The agreement must show the fee in dollars and as an APR.

Question 3Can I roll over a Mississippi payday loan by paying only the fee?
Answer

No. Mississippi prohibits renewing or extending a delayed-deposit check and prohibits paying one check with another from the same licensee or an affiliate. The original check must be paid or deposited before a new transaction.

Question 4How long can a delayed-deposit transaction last?
Answer

A check with a face amount of $250 or less may be delayed for up to 30 days. A check above $250 and up to $500 must be scheduled for at least 28 days and no more than 30 days.

Question 5Where can I report a Mississippi payday-loan problem?
Answer

First ask the company to resolve the issue in writing. If it remains unresolved, file a consumer complaint with the Mississippi Department of Banking and Consumer Finance and include the legal company, timeline, agreement, payments and supporting records.
