Candidate services, not a state-availability guarantee

A marketplace may accept a ZIP code but still fail to find a licensed lender or suitable product. Confirm the legal creditor and servicer, current license, product classification, periodic rate, aggregate balance, income test, payment authorization and next-business-day rescission right.

Oklahoma payday-loan rules: the direct answer

As of August 27, 2026, Oklahoma’s former Deferred Deposit Lending Act is not a route for making new traditional payday loans. Section 59-3101.1 ended new deferred-deposit transactions on August 1, 2020 and terminated those licenses, while allowing legacy balances to be administered until paid. A website that still advertises a new post-dated-check payday advance should therefore be treated as a product-classification and licensing question, not as proof of current availability.

Oklahoma now has a separate Oklahoma Small Lenders Act for licensed small loans. That model is not automatically the same as a two-week payday loan: it has its own license, periodic-rate limit, aggregate principal and income-payment test, payment controls, written disclosures and rescission rules. Compare the agreement’s legal product name and the creditor’s license with the current statute rather than relying on a “cash advance” headline.

The Oklahoma Department of Consumer Credit (OK DCC) licenses and supervises small lenders, supervised lenders, money brokers and other non-depository businesses. Verify the exact legal entity through the department’s official resources or NMLS before submitting a Social Security number, bank login or recurring ACH authorization.

The 2020 transition and why old payday pages mislead

The archived Deferred Deposit Lending Act describes the historic product as a cash advance against a dated instrument held for later presentment. It also contains old figures such as a $500 advance, a 12-to-45-day term, and a tiered finance charge. Those provisions explain historical agreements and comparison searches, but they do not authorize a new transaction after the statutory termination date. Do not use an old fee chart, cached lender page or legacy license number to approve a current offer.

Section 59-3101.1 allows a former deferred-deposit licensee to collect outstanding loans made before August 1, 2020 until they are paid in full. A collection message about an old balance is different from a new application. Ask the sender for the original agreement, transaction date, current owner of the account and lawful payment history. A demand to “renew” a legacy payday loan or send a release fee for a new one is a serious warning sign.

For a current offer, the relevant question is whether the creditor is licensed under the Oklahoma Small Lenders Act, the Uniform Consumer Credit Code or another documented authority. A broker or affiliate may introduce the application but is not necessarily the creditor. Record the legal lender, servicer, license number, address, governing law and every entity receiving your data.

Oklahoma Small Lenders Act: rate, balance and income checks

A licensee under the Oklahoma Small Lenders Act may charge periodic interest of no more than 17% per month unless another Title 59 provision applies. Because a monthly percentage can produce a very high annualized cost, compare the disclosed finance charge and total dollars due rather than treating the monthly number as a normal annual APR. The contract must provide a clear written explanation of fees and charges and state that the borrower may prepay without penalty.

The maximum aggregated principal of small loans outstanding across all licensees for one customer is $1,500, subject to the statutory adjustment mechanism. Lenders must verify outstanding amounts through an approved private database. A separate database charge may be imposed on the lender by the database provider within the statute’s limit. A new URL, affiliate or payment processor should not be used to hide a balance or bypass the aggregate check.

A lender may not make a small loan when the total scheduled payments coming due in a month would exceed 20% of the borrower’s gross monthly income. The creditor must obtain and keep proof of income or third-party verification used for that calculation. Ask how the payment test was computed and include other small-loan payments when checking whether the proposed schedule is realistic.

Electronic debits, defaults and the right to rescind

Oklahoma allows several payment methods, including ACH and remotely created checks, but an electronic payment requires written borrower authorization. Before the first transfer, the lender must give written notice, and after a second failed payment caused by insufficient funds, it must obtain additional written approval for another electronic attempt. Read the authorization for amount, date, frequency and revocation instructions rather than accepting a blanket “all debits” consent.

A returned check, ACH or remotely created check may result in a fee of up to $25 under the Small Lenders Act. If a default is referred to an attorney and the agreement allows it, a reasonable attorney fee may be collected up to 15% of the outstanding amount. These limited charges do not permit a provider to invent membership, verification or release fees. Request an itemized payoff and dispute unexplained additions in writing.

Every current small loan must include a rescission right. The lender cannot require the right to continue beyond the close of business on the day after disbursement, unless it is closed then, in which case the next open business day applies. The written explanation must also tell the customer how to complain to the Administrator. Save the contract, rescission notice, timestamp and proof that funds were returned.

Contract terms, advertising and collection conduct

The Small Lenders Act prohibits unfair or deceptive acts and agreements designed to obtain charges greater than the statute allows. It also requires compliance with Oklahoma Regulation Z, the Equal Credit Opportunity Act and the Fair Debt Collection Practices Act. A small-loan agreement cannot choose another state’s law, force consent to another state or foreign country’s jurisdiction, or establish an improper venue; a provision doing so is void under the statute.

Advertising must match the legal product and the actual cost. “Guaranteed approval,” “no-risk cash,” a fake government seal or a countdown that demands immediate payment is not a substitute for a license and contract. Do not send gift cards, cryptocurrency or a prepaid “insurance” amount to unlock a loan. If a collector threatens arrest for a returned instrument, preserve the message and ask OK DCC which authority covers the named company.

The department may investigate licensed and suspected unlicensed activity and has exclusive administrative power over non-criminal complaints involving small-loan businesses. A complete complaint includes the legal entity, URL, agreement, screenshots, bank statements, payment attempts and a dated chronology. Send copies, keep originals and contact the bank promptly about an unauthorized debit.

Oklahoma borrower verification checklist

Borrow Radar calculators can model a monthly rate, income-based payment margin and total payoff, but they do not determine whether the creditor is licensed or whether a legacy Oklahoma law applies. Use the signed disclosure as the source of truth. If the payment would consume essential income or require another advance, compare a credit union, employer assistance, nonprofit counseling or a bill extension first.

  1. Separate a legacy pre-August-2020 deferred-deposit balance from a new offer; do not accept a new traditional payday transaction on an old license claim.
  2. Identify the actual creditor, servicer, broker and affiliates; verify the current license and legal product through OK DCC or NMLS.
  3. For a Small Lenders Act loan, check the 17% monthly interest ceiling, $1,500 aggregate principal limit and 20% gross-income payment test.
  4. Read the written fees, total repayment, payment dates, ACH or RCC authorization, second-failed-payment rule and $25 returned-payment charge.
  5. Record the next-open-business-day rescission deadline and prepayment-without-penalty statement before accepting funds.
  6. Reject upfront fees, fake legal threats, out-of-state governing-law clauses and any attempt to hide balances through an affiliate or new URL.

Oklahoma payday-loan FAQ

Question 1Are new traditional payday loans legal in Oklahoma?
Answer

The Deferred Deposit Lending Act ended new deferred-deposit transactions on August 1, 2020 and terminated those licenses. A current offer must be analyzed under another documented authority, such as the Oklahoma Small Lenders Act, rather than an old payday license.

Question 2What is the Oklahoma Small Lenders Act interest limit?
Answer

A Small Lenders Act licensee may charge periodic interest of no more than 17% per month unless another Title 59 provision applies. Review the annualized cost and total dollars in the written disclosure.

Question 3How much small-loan principal can one Oklahoma borrower have?
Answer

The aggregate principal of small loans outstanding across all licensees is limited to $1,500, subject to the statutory adjustment mechanism and database verification.

Question 4Can an Oklahoma lender debit my account repeatedly?
Answer

Electronic payments require written authorization and advance notice. After a second failed attempt caused by insufficient funds, the lender must obtain additional written approval for another electronic attempt.

Question 5Where can I verify or report an Oklahoma lender?
Answer

Start with the Oklahoma Department of Consumer Credit and its official licensing or NMLS resources. Include the agreement, advertisements, payment records and a dated timeline in a complaint; contact your bank immediately about an unauthorized debit.
