Wyoming payday-loan rules: the direct answer

As of August 27, 2026, Wyoming permits a licensed post-dated check casher to make a payday-style advance. The Wyoming Uniform Consumer Credit Code calls the product a post-dated check or similar arrangement rather than relying on marketing language. A lender must be licensed, including when it regularly conducts covered transactions online, and the legal creditor should be identifiable before a borrower authorizes a check or electronic debit.

The maximum term is one calendar month. The post-dated-check finance charge cannot exceed the greater of $30 or 20% per month of the principal balance, and the charge is fully earned when the arrangement is made. These are statutory limits for the defined product, not a recommendation to borrow. Compare the dollars advanced, fee, due date and bank-access terms with a lower-cost alternative before applying.

Wyoming licensing and online lender checks

The Wyoming Division of Banking lists a post-dated check casher as an entity that provides post-dated-check payday loans. Licensing is mandatory for every location where business is regularly conducted, including online transactions. The Division uses the Nationwide Multistate Licensing System (NMLS) for applications and renewals, while its licensee list provides a starting point for checking consumer-lender and post-dated-check-casher records.

Search the exact legal name shown in the final agreement, not only a comparison brand or lead-generator name. Ask where the contract is made, who owns the payment authorization, which entity holds the license and whether a separate servicer will collect. A bank-partner logo, tribal statement or out-of-state mailing address does not by itself establish that the provider can make a Wyoming post-dated-check loan.

Wyoming’s Division of Banking publishes a post-dated-check-casher information booklet and annual-report requirements. Save the offer screen, fee disclosure, written notice, agreement, payment authorization and every confirmation email. If a lender changes its name after approval, compare the new entity with the license record before allowing another debit or sending a replacement check.

One-month term, $30 minimum and 20% monthly ceiling

For a covered post-dated-check arrangement, Wyoming law limits the term to one calendar month. The statutory finance charge is the greater of $30 or 20% per month of the principal balance. On a $300 advance, the 20% calculation is $60; on a $100 advance, the $30 minimum produces the larger permitted charge. The contract should show principal, fee, amount due and maturity date separately so the calculation can be checked.

The fee is fully earned on the day the post-dated check or similar arrangement is made. That rule means a very early payoff may not produce the same refund that a longer installment loan would. Ask for a payoff quote, but do not assume the full finance charge will be rebated. A lender cannot add a separate “verification,” membership or release amount that is outside the permitted post-dated-check charge.

The one-month limit does not apply in the same way to a statutory extended payment plan. That plan is a different repayment structure with its own request deadline, installment count and no-additional-cost condition while the consumer remains current. Make sure the provider labels any extension as an extended payment plan rather than quietly writing a new payday arrangement.

Rescission and the extended payment plan

A Wyoming consumer may rescind a post-dated-check arrangement on or before 5 p.m. Mountain Time on the following business day by returning the full original amount advanced in cash or certified funds. The rescission must be at no cost, and the lender must provide written instructions at consummation. Request a dated receipt and confirmation that the check or electronic authorization is no longer available for presentation.

If you cannot repay on the due date, you may elect an extended payment plan once every 12 months, measured under the statute’s timing rule. The request must be made before 5 p.m. Mountain Time on the last business day before the due date, and you must sign an amendment memorializing the plan. Waiting until the due date has passed can forfeit the opportunity, so contact the lender early and keep proof of delivery.

The plan must allow repayment in at least four substantially equal installments over at least 60 days. Installments are due on or after regular-income dates, or at least two weeks apart when the consumer has no regular income. While the consumer follows the plan, there is no additional cost, interest or fee, and prepayment is allowed without penalty. Missing an installment can trigger acceleration and the statutory post-default interest rule, so keep a calendar and payment receipts.

No same-lender rollover and written consumer notice

Wyoming prohibits a post-dated check or similar arrangement from being repaid, refinanced or consolidated with proceeds from another post-dated arrangement accepted by the same casher. An offer to “renew” through a new application, affiliate or slightly different URL should be checked against the legal entity and this rule. A new agreement does not erase the original payment obligation or make the combined cost affordable.

The statute requires a written notice with each post-dated check or similar arrangement, with the consumer’s signed acknowledgment at least annually. The notice explains the no-same-casher-refinance rule and warns that payday advances are for short-term needs, not a long-term financial solution. Keep that notice with the contract; it helps establish what the lender disclosed and what you accepted.

For a comparison page, an offer card is only a candidate connection service. It is not a finding that a network lender holds a Wyoming post-dated-check-casher license or will use the statutory fee. After a match, capture the final creditor, NMLS or Division record, principal, fee, term and payment method before deciding whether the result is usable.

Default, collection conduct and complaints

If an extended payment-plan installment is missed, the casher may accelerate the remaining balance and take lawful collection action. The statute allows post-default interest at an annual rate equal to 6% plus the prime rate listed in the Wall Street Journal on January 1 of the default year. Ask for the balance and calculation in writing. Do not assume that a returned check changes the debt into a criminal matter.

Preserve voicemails, letters, caller IDs, bank notices, screenshots and payment confirmations. A collector that threatens arrest, demands gift cards or asks for a release fee before funding is a serious warning sign. Contact the bank promptly about an unauthorized electronic debit, but keep the original statement and the agreement for the complaint file.

The Wyoming Division of Banking provides consumer-lending information, a licensee list and complaint resources. Try to resolve a billing error with the creditor first, then send the Division copies of the agreement, written notice, payment history, advertising and a dated chronology. Its jurisdiction may not cover a national bank or an entity with no Wyoming authority, so the legal creditor determines the next regulator.

Wyoming borrower checklist

A Wyoming payday-loan comparison should lead with the legal creditor and the total dollars due, not the speed of a match. A credit-union small-dollar loan, employer advance, nonprofit assistance or a negotiated bill extension may avoid a one-month fee that consumes the next paycheck. A statutory right to rescind or request a plan is valuable only when the borrower tracks deadlines and keeps proof.

  1. Verify the exact creditor and post-dated-check-casher license through the Wyoming Division of Banking or NMLS before sharing account details.
  2. Confirm the term is no more than one calendar month and recalculate the fee as the greater of $30 or 20% per month of principal.
  3. Read the written notice, rescission instructions, check or ACH authorization and no-same-casher-refinance rule before signing.
  4. Record the following-business-day, 5 p.m. Mountain rescission deadline and the cash or certified-funds delivery method.
  5. If repayment is difficult, request the extended plan before 5 p.m. on the last business day before due date; keep the signed amendment and four-payment schedule.
  6. Stop when the lender hides its legal name, requests an upfront release fee or refuses to provide a Wyoming license record; preserve evidence for the Division.
