Candidate services, not a state-availability guarantee

A marketplace may accept a ZIP code but still fail to find a licensed lender or suitable product. Confirm the actual creditor, DFPI license, product type, $300 face-amount ceiling and written fee before proceeding.

California payday-loan rules: the direct answer

California permits a licensed form of payday lending called a deferred deposit transaction. The Department of Financial Protection and Innovation, or DFPI, licenses and examines the businesses that originate these transactions under the California Deferred Deposit Transaction Law. A consumer gives the originator a personal check or electronic equivalent, receives less cash than the face amount, and authorizes collection at a later date.

The check amount cannot exceed $300, the fee cannot exceed 15 percent of that face amount, and the term cannot exceed 31 days. Those numbers describe the state payday product, not every small personal or installment loan advertised to a California resident. A larger amount, longer schedule or different pricing model may fall under another law and license, so the final contract must be classified before its price is compared with the payday limits.

An online matching service is not automatically a California payday lender. It may only transmit a request to participating companies. After a match, identify the creditor named in the agreement, determine which license covers that product, and search the legal entity rather than relying on the first website’s brand or ZIP-code field.

How the $300 check limit and 15% fee work

California measures the ceiling by the face amount of the consumer’s check or electronic equivalent. If the check is $300 and the originator charges the maximum 15 percent fee, the fee is $45 and the consumer receives $255. The obligation due at collection is still $300. Describing that transaction as a $300 cash advance would therefore overstate the money placed in the borrower’s hands.

For a smaller illustration, a $200 check with a 15 percent fee produces $170 in net proceeds and a $30 finance charge. Annualizing a short charge can produce a triple-digit APR even though the dollar fee looks limited. Use the Truth in Lending disclosure and the actual number of days rather than estimating from a marketing phrase such as “until payday.”

The statutory maximum is not a recommendation and does not prove affordability. A $45 charge can still be expensive if repaying $300 removes money needed for rent, utilities, transportation or food. Compare the net cash received with every dollar that must leave the account on the collection date.

Term, repeat borrowing and payment-plan limits

The deferred deposit term may not last longer than 31 days. A licensee cannot make a new deferred deposit transaction while an earlier one from that licensee remains in effect, even when the combined checks would stay below $300. The proceeds of a new transaction from the same licensee also cannot be used to pay an existing transaction. These rules prevent a same-lender rollover from being presented as fresh cash.

DFPI guidance says a licensee may extend the due date or offer a payment plan but is not required to do so. When it grants an extension or plan for the outstanding payday transaction, it may not add a new fee or charge for that accommodation. Obtain the changed dates and authorized debit amounts in writing; a verbal promise is not enough to reconcile a later bank withdrawal.

California does not impose a simple annual count limit in the DFPI guidance, so repeated use remains possible after prior transactions close. That makes household cash-flow review important. A pattern of borrowing again shortly after repayment can show that the original expense was postponed rather than solved.

Verify the license before sharing bank information

Search the legal business name through the licensing route linked by DFPI. Match the address and license details to the party shown in the agreement. A similar trade name, search advertisement or accessible California web form is not a substitute for the record. If a lead generator sends the request elsewhere, repeat the check for the actual originator.

A lender offering a different installment product may hold a California Financing Law license rather than a payday-lender license. Do not force that contract into the deferred-deposit rules merely because the advertisement used “cash advance” language. Record the amount financed, payment schedule, APR, finance charge and license type that actually appear in the documents.

Stop if a company asks for an upfront approval payment, gift card, cryptocurrency transfer or remote access to a device. Those demands do not belong in the disclosed payday fee. Preserve the page, message, telephone number and payment instructions for a complaint or fraud report.

Read the agreement and electronic-debit authorization separately

Before accepting, save the signed agreement and federal cost disclosure. Confirm the face amount, net proceeds, fee, APR, collection date and the originator’s legal identity. If any figure on the checkout screen differs from the document, use the final disclosure for the decision and ask why the presentation changed.

An ACH authorization should state the dates and amounts that may be withdrawn. DFPI’s licensing FAQ says varying electronic debits to collect a delinquent account require authorization in the agreement or an addendum specifying those amounts and days. Monitor the account and challenge a debit that falls outside the authorization. Revoking a payment authorization does not by itself erase the debt.

A returned-check event may add one charge of up to $15 under the DFPI guidance, but additional late or returned-check fees are not authorized for the deferred deposit transaction. The consumer’s own bank can still impose a separate overdraft or nonsufficient-funds fee. Include both possible consequences in the repayment decision.

Compare the deadline with lower-cost California options

Begin with the bill creating the emergency. Ask the utility, medical office, landlord or creditor whether a short extension or hardship arrangement is available and what it costs. A documented late fee may be materially less than surrendering $45 from $300 of near-term cash, especially when the loan would create another shortage on the collection date.

Credit unions, community banks, employer programs and nonprofit organizations may offer small-dollar assistance with a longer repayment schedule. California residents can also use 211 to look for food, housing, utility or health resources. When several accounts are already overdue, a nonprofit credit counselor can help organize the entire cash-flow problem rather than financing one due date.

State rule does not verify an online offer

The offer profiles on this page are reviewed national referral or lead-generation services. A matched creditor must independently satisfy California licensing and product rules; Borrow Radar does not label the first form as a California lender.

California payday-loan FAQ

Question 1What is the maximum California payday-loan amount?
Answer

For a deferred deposit transaction, the personal check or electronic equivalent cannot exceed $300. Because the fee may be deducted from that amount, the cash received can be lower; at the maximum 15 percent fee, a $300 check produces $255 in proceeds.

Question 2Can a California payday lender roll an existing loan into a new one?
Answer

A licensee cannot use proceeds from a new deferred deposit transaction to pay its existing transaction or open another while the earlier one is in effect. A voluntary extension or payment plan may be offered without additional fees, but the lender is not generally required to grant one.

Question 3Does a website accepting a California ZIP code prove availability?
Answer

No. A form may belong to a matching or lead-generation service and may collect a request before identifying a creditor. Verify the legal lender, product type, written terms and applicable DFPI license after any match.

Question 4Where can a California borrower report a payday-lender problem?
Answer

DFPI accepts complaints about financial services it regulates. Include the legal business name, agreement, license information, payment records, screenshots and communications so the agency can identify the transaction and entity.
