Delaware payday-loan rules: the direct answer
Delaware permits licensed short-term consumer loans. The statutory category covers a loan of $1,000 or less, made to an individual, carrying interest or fees, with a stated repayment period shorter than 60 days and without a motor-vehicle title as security. The state regulates this product through Title 5, Chapter 22 rather than imposing the familiar flat fee ceiling used by several neighboring payday-loan systems.
A borrower may receive no more than five short-term consumer loans from all licensees during any rolling 12-month period. A rollover or refinancing counts as another loan for this limit, and an existing obligation may be rolled over no more than four times. The statewide database is designed to let a licensee test eligibility before proceeding.
Offer cards below summarize nationally marketed connection services, not a regulator-approved Delaware lender list. A service can accept a form without proving that the eventual creditor is licensed, that the product fits the statutory definition or that its price is sensible. Verify the legal lender and final agreement independently before authorizing a credit check or account debit.
What counts as a Delaware short-term consumer loan
Four facts define the state category: principal no greater than $1,000, an individual borrower, a term under 60 days and an interest or fee charge. A vehicle-title loan is outside this definition because Chapter 22 regulates title lending separately. A longer installment contract may also fall under the broader licensed-lender rules without receiving every safeguard discussed on this page.
Product names are not decisive. Delaware’s anti-evasion provision reaches websites, brokers and disguised revolving-credit structures. Compare the amount delivered, repayment date, mandatory charges and renewal mechanics, then repeat the classification check when a marketplace reveals the actual creditor.
Interest, fees and the real cost of a Delaware offer
Delaware does not place one simple payday APR ceiling in Section 2235A. Section 2229 permits a licensed lender to charge the periodic rate stated or established by the agreement, while Section 2237 disapplies other state limits to credit made under this subchapter. Authorized charges and federal disclosure duties still matter, but the absence of a single headline cap makes price comparison essential.
Every short-term provider must publish its applicable fee and rate schedule at the office entrance and on its website. The same location must prominently explain that a payday loan is not intended to meet long-term financial needs. A generic network range is not the lender-specific schedule: save the creditor’s version and reconcile it with the Truth in Lending disclosure before accepting.
For scale, a $500 advance with a $75 finance charge due after 14 days requires $575 and represents a simple annualized rate of about 391%. A $300 advance with a $45 charge due after 30 days requires $345 and annualizes to about 183%. These examples illustrate the mathematics only; they are neither quotations nor statements of a permitted maximum.
Use the written amount financed, every finance charge, APR, due date and total of payments. A loan can satisfy a transaction limit while remaining too expensive for the household budget.
Five-loan limit and the statewide database
The five-loan limit applies across all licensed providers, not five per storefront or website. It looks back over 12 months, so changing companies does not reset the count. Rollovers and refinancings consume another position. A transaction made or collected in violation of this rule is void, and the statute denies the licensee a right to collect or retain principal, interest, fees or other charges.
The Commissioner’s common real-time database shows whether a borrower has an outstanding covered loan, the number outstanding and eligibility under the annual limit. When a loan is made, the licensee must promptly submit identifying and transaction data, including gross monthly income, amount, interest rate, date and anticipated payoff. It must update the record when the balance is paid.
The database transaction fee is payable by the licensee and cannot be passed to the customer. Identifying information is protected from public-record access and scheduled for routine deletion 12 months after payoff.
Next-business-day cancellation and prepayment
Every Delaware short-term consumer loan must carry a right of rescission. The borrower may return the complete amount borrowed by close of business on the business day after disbursement without a fee or other charge. For this rule, business days exclude Sundays and legal public holidays. Obtain the lender’s return instructions before funds arrive so the short window is usable.
Rollovers, refinancing and a 90-day workout
A rollover extends an unpaid short-term debt past its stated repayment period solely in exchange for a fee and without a newly approved application. Delaware allows no more than four rollovers of an existing loan, but each rollover also counts toward the broader five-loan annual limit. That interaction can exhaust the annual allowance through one repeatedly extended balance.
Additional fees may accrue with each rollover. A consumer who pays only an extension charge can spend more while owing the same principal, so model every proposed cycle with the rollover calculator. The decisive question is not whether the next fee fits today; it is whether reliable income can cover the eventual principal, accumulated charges and essential expenses on the revised date.
After no more than the permitted rollovers, a lender may enter a workout agreement or take lawful collection steps. A statutory workout uses equal installments over at least 90 days and adds no fee, interest or other charge because of the conversion. Request the complete schedule in writing and confirm that each payment reduces the balance to zero.
Licensing and online matching services
A nondepository business making more than five consumer-loan transactions in a 12-month period generally needs a Delaware licensed-lender authority unless an exemption applies. The Office of the State Bank Commissioner describes the license as covering closed-end unsecured personal lending, payday lending, title lending, collateral loans and other nonbank consumer credit.
Search the Commissioner’s current Licensed Lender report by legal name, trade name and address, then compare it with the agreement. A marketplace, lead generator and creditor can be different companies; a national availability map is weaker evidence than a current license record and a contract naming the legal lender.
Required warnings, debits and default conduct
The loan application must be written in English and Spanish and conspicuously state three points: the product is a short-term cash-flow solution rather than a remedy for longer financial problems; rollover can add fees; and credit counseling is available. Missing warnings are a reason to pause and preserve the application screen.
Review the debit authorization separately from the loan agreement. Record the exact amount or method, permitted dates, retry language and cancellation process. A failed check or ACH transfer does not allow a licensee to pursue or threaten criminal action over nonpayment. It may still use lawful civil collection methods and contract remedies, so respond to notices and court papers on time.
Delaware offer-comparison checklist
Before borrowing, ask the biller for a payment arrangement, due-date change or fee waiver. Compare a credit-union small-dollar product, a regulated bank option, employer assistance and Delaware 211 resources. A cheaper installment structure can still strain cash flow, so place the exact payment beside housing, utilities, food, transportation and existing debt.
- Identify the actual lender, matching service, servicer and every company receiving personal or bank data.
- Confirm the creditor in the latest Delaware Licensed Lender report and check the legal name on the contract.
- Verify principal of $1,000 or less, a term under 60 days and your remaining five-loan database eligibility.
- Copy the posted rate schedule; compare amount financed, finance charge, APR, payoff and all optional products.
- Count every prior loan, refinance and rollover in the rolling 12-month window before accepting another transaction.
- Save rescission instructions, bilingual warnings, debit authorization, payment history and all communications.
How to document a Delaware lending problem
The Office of the State Bank Commissioner investigates complaints concerning state-regulated financial institutions and licensed nonbank companies. A useful file includes the advertisement, complete application path, agreement, disclosures, fee schedule, database or eligibility message, proof of funding, bank statement, payment ledger and correspondence.
Delaware payday-loan FAQ
- Question 1Are payday loans legal in Delaware?
- Answer
Yes. Delaware permits licensed short-term consumer loans of $1,000 or less with a stated term under 60 days, subject to transaction limits, rescission, disclosures, database reporting and other Chapter 22 rules.
- Question 2How many payday loans can a Delaware borrower receive?
- Answer
No more than five short-term consumer loans from all licensees in any 12-month period. Each rollover or refinancing counts as another loan for that limit.
- Question 3Does Delaware cap payday-loan APR at one fixed number?
- Answer
Chapter 22 does not provide one simple payday APR ceiling. The licensed lender charges the rate provided by the agreement and must post its applicable rate and fee schedule, so the complete written price should be compared carefully.
- Question 4Can a Delaware payday loan be canceled?
- Answer
A covered borrower may return the full amount borrowed by close of business on the following business day without a fee or other charge. Follow the lender’s return instructions and keep proof.
- Question 5Can a lender threaten arrest for a failed payday-loan debit?
- Answer
No. A licensee may not pursue or threaten criminal action for nonpayment, including an unpaid returned check or ACH transaction, although lawful civil collection options may remain.
