Candidate services, not a state-availability guarantee

A marketplace may accept a ZIP code but still fail to find a licensed lender or suitable product. Confirm the actual provider in OFR’s license system, the database transaction, applicable amount limit, fee calculation and payment schedule.

Florida deferred presentment: the direct answer

Florida permits payday lending through licensed deferred presentment providers supervised by the Florida Office of Financial Regulation, or OFR. The governing rules appear in Part IV of Chapter 560, Florida Statutes. State law distinguishes a transaction repaid at the end of a short deferment period from a deferred presentment installment transaction with several scheduled payments.

For the non-installment form, the check face amount may not exceed $500, the provider fee may not exceed 10 percent of the currency or payment instrument supplied, and a separate verification fee may apply. The term must be at least 7 days and no longer than 31 days. Florida’s consumer page currently describes the verification fee as $5.

The installment form may have a check face amount or outstanding balance up to $1,000, lasts from 60 through 90 days, and uses a different charge method: fees may not exceed 8 percent of the outstanding balance on a biweekly basis. It must be fully amortizing. A consumer should therefore identify which form is being offered before comparing amount, fee and repayment rights.

Single-payment amount, fee and payoff example

Suppose a Florida consumer receives $400 in a non-installment deferred presentment transaction. A 10 percent provider fee would be $40, and the OFR-described $5 verification fee would bring the example cost to $45. The exact agreement and current rule control; the calculation illustrates the components rather than quoting a particular lender. The consumer would need enough cash for the documented payoff at the agreed date.

A provider cannot collect the authorized transaction fee before the check is presented or redeemed, and it cannot add an early-payment penalty. The agreement must disclose the check amount, deferment length, final day, payment obligations, provider identity and database transaction number. Federal Truth in Lending disclosures also apply.

Florida prohibits a rollover that charges another fee to delay the same transaction. A provider or affiliate also cannot redeem, extend or consolidate the agreement with proceeds from another deferred presentment transaction. These restrictions matter when a representative suggests a “new” advance as the way to cover the old check.

How Florida installment deferred presentment differs

A deferred presentment installment transaction is not simply a 31-day loan split informally. Its statutory term is 60 to 90 days, installments must be consecutive and as nearly equal as mathematically practicable, and the schedule cannot contain a balloon payoff. Payment intervals are generally no fewer than 13 days and no more than one calendar month.

The 8 percent biweekly charge applies to the outstanding transaction balance using simple-interest treatment described by the statute and implementing rules. As principal falls, the balance used for later charges should also fall. Read the schedule line by line instead of multiplying the first charge across every period. Prepayment penalties are prohibited, and unearned fees should not be treated as though the full original term elapsed.

Florida permits one scheduled installment payment to be deferred without an added fee when the borrower gives the required notice by noon of the business day before it is due. The payment moves after the last scheduled installment. This is a defined state protection, not permission to skip the debt or repeatedly move every due date.

One outstanding transaction and the statewide database

A consumer may not have more than one deferred presentment transaction outstanding at a time across providers. After closing a transaction, the consumer must wait at least 24 hours before entering another. Providers use the state database to check for an open transaction or a recent closure before originating the next agreement.

The database requirement is an eligibility control, not a recommendation to borrow whenever the record allows it. Repeated transactions can still drain future paychecks. It also means the application involves sensitive identifying data. Confirm that the party collecting Social Security, driver-license, employment or bank information is the licensed provider or an accurately disclosed intermediary using an appropriate secure flow.

A national referral site may not know the Florida provider until after it distributes the request. Once a response arrives, search the creditor or deferred presentment provider through OFR’s REAL license system. A brand shown on the first page may differ from the legal entity that must appear in the state record and signed agreement.

The 60-day grace period for a payment problem

For a non-installment transaction, Florida provides a 60-day grace period without an additional charge when the consumer informs the provider by the end of the deferment period that full payment cannot be made and follows the counseling conditions. The borrower must arrange an appointment with an approved consumer credit counseling agency within seven days and complete counseling during the grace period.

The provider supplies the applicable notice and list of approved agencies. A payment plan approved through counseling can become part of the resolution. Keep proof of the appointment, completion notice and any schedule. Missing the required steps can allow the provider to present the check and use available civil collection methods after the protection ends.

For an installment transaction, the separate one-payment deferral rule applies instead of treating the whole balance as a non-installment grace-period case. Contact the provider before the statutory notice deadline and request written confirmation of the moved payment. Do not rely on a telephone assurance while an ACH withdrawal remains scheduled.

A practical Florida contract and license check

Do not pay an advance fee for guaranteed approval or send money through a gift card, cryptocurrency kiosk or person-to-person transfer to “release” loan proceeds. Those instructions do not match the regulated fee collection described in the Florida deferred presentment law. Report suspicious demands with screenshots and payment details.

  1. Decide whether the document is a non-installment or installment deferred presentment agreement.
  2. Match the provider’s legal name and location with an active Florida money-services-business record and deferred-presentment authority.
  3. Recalculate the supplied cash, permitted fee formula, verification fee, payoff and every due date.
  4. Confirm the agreement contains its state database number and the required federal cost disclosures.
  5. Read the check or electronic-transfer authorization and save it before funds are disbursed.
  6. Place the payoff beside essential expenses due from the same income period and compare alternatives.

Florida alternatives before committing a paycheck

Ask the original biller what a short delay actually costs. Utilities, medical providers, landlords, insurers and other creditors may have due-date changes or hardship processes. Compare the written consequence with the loan’s total dollars, not only the promise of fast funding. United Way 211 can point residents toward local emergency resources.

A credit union small-dollar loan, employer advance, family arrangement or nonprofit assistance may spread the obligation without a deferred check. When the budget is already short every month, counseling can be more useful before a new loan than only after default. Preserve enough cash for food, housing, medicine and transportation when evaluating any schedule.

Offer cards are a research starting point

The services listed above have active reviewed profiles and do not publish Florida in the exclusion lists Borrow Radar checked. Only a matched Florida-authorized provider and compliant written product can establish real availability.

Florida payday-loan FAQ

Question 1How much can a person borrow through a Florida payday loan?
Answer

A non-installment deferred presentment check may not exceed $500, exclusive of allowed fees. A deferred presentment installment transaction can have a check face amount or outstanding balance up to $1,000 and follows a 60-to-90-day amortizing schedule.

Question 2Can a Florida borrower have two payday loans at once?
Answer

Florida prohibits an outstanding deferred presentment transaction with another provider and uses a statewide database for verification. A consumer also must wait at least 24 hours after terminating a prior transaction before opening another.

Question 3What happens if a Florida single-payment transaction cannot be paid?
Answer

The statute provides a 60-day no-additional-charge grace period when the borrower gives timely notice and completes the required approved credit-counseling steps. The agreement’s notice explains the deadlines and conditions.

Question 4Where can a Florida payday-lender license be checked?
Answer

Use the Florida Office of Financial Regulation license-verification resources and search the legal entity shown in the agreement. OFR also accepts consumer complaints about regulated deferred presentment providers.
