Idaho payday-loan rules: the direct answer
Idaho permits payday loans made by licensed or exempt providers. A single loan’s principal cannot exceed $1,000, and the lender cannot make a payday loan exceeding 25% of the borrower’s gross monthly income when the loan is made. Those are amount tests, not a statewide APR cap.
The Idaho Payday Loan Act requires a signed agreement showing the principal and total fee in dollars and as an annual percentage rate. Its payday provisions do not state a fixed numerical ceiling for the ordinary origination fee. A lawful amount can therefore remain very expensive, especially when a short term turns a seemingly simple fee into a triple-digit APR.
Offer cards below describe candidate matching and referral services, not verified Idaho lenders. A national form can accept personal data without proving that the eventual creditor has an Idaho license, offers a payday product, satisfies the income test or has disclosed the complete price. Verify the actual creditor before proceeding.
What counts as an Idaho payday loan
The statutory product is a written transaction in which a creditor accepts a borrower’s check, agrees to hold it before negotiation or deposit and advances the check amount less the allowed fee. “Check” includes an electronic equivalent, such as authority to withdraw an agreed amount from the borrower’s account.
That definition matters online. A website may call its product a cash advance, same-day loan or emergency loan, but the funding and repayment mechanics determine whether the payday rules apply. An installment loan with scheduled principal payments may instead fall under other Idaho Credit Code provisions. Do not transfer a payday conclusion to a differently structured contract.
$1,000 principal and 25% gross-income tests
Section 28-46-412 caps the principal of any payday loan at $1,000. Separately, a licensee and persons related by common control may not have more than $1,000 of aggregate principal outstanding to one borrower, plus allowable fees. Splitting a request between branches of the same controlled business does not enlarge that balance.
Section 28-46-413 adds the borrower-specific income limit: the new loan cannot exceed 25% of gross monthly income. At $2,400 of gross monthly income, that test produces $600; at $5,000, the separate $1,000 principal ceiling becomes lower. Gross income is before deductions and is not the same as money remaining after housing, taxes and essential expenses.
The lender must obtain income information at least once every twelve months and may rely on evidence or the borrower’s written representation. Statutory eligibility does not prove affordability; test the payoff against net income and earlier obligations.
Fees, payoff and APR examples
Idaho allows a payday lender to charge a fee that is treated as fully earned on the transaction date and not as interest for state-law purposes. The lender may not add other charges unless the Act specifically permits them. Each licensed location must post its payday fee as dollars per $100, and the signed agreement must translate the complete fee into dollars and APR.
Suppose a hypothetical $500 principal carries a $20 fee per $100 for fourteen days. The fee is $100, the payoff is $600 and the simple annualized rate is about 521%. At $15 per $100, the fee is $75, payoff is $575 and the same illustration is about 391%. These examples are not lender quotes or substitutes for the required federal APR disclosure.
Compare usable cash, fee per $100, dollar finance charge, days outstanding, APR and total payoff. Do not treat “no interest” language as low cost when the transaction uses a large fully earned fee.
Idaho limits principal and income exposure but does not place a fixed numerical ceiling on the ordinary payday fee in these provisions. The posted fee, written dollar charge and APR are essential comparison fields.
Checks, electronic debits and returned payments
The advance may be delivered by cash, business check, money order or electronic transfer without an added access fee. Repayment can use cash, the borrower’s check or an agreed debit card, electronic transfer or other reasonable method.
For a check-secured transaction, the lender may accept only one postdated check for the loan and must endorse it in the actual business name before presentment. The borrower can redeem it before deposit by paying the full check amount in cash or immediately available funds. A lender may make no more than two electronic re-presentments of a borrower’s check.
If a check is returned, a disclosed charge authorized by Idaho Code § 28-22-105 may apply; the current statutory collection-cost ceiling is generally $20. The payday lender cannot demand treble damages. Preserve bank notices and transaction attempts so duplicate or unauthorized debits can be disputed with specific dates and amounts.
Three renewals and no post-payoff cooling-off period
A licensee may renew a payday loan no more than three consecutive times. The required consumer notice warns that renewal creates additional fees. After the third renewal, the borrower must repay the loan in full rather than pay for a fourth extension. The same lender or a commonly controlled person cannot use proceeds from another payday loan to repay it.
Once the earlier transaction is completed, Idaho permits a new loan with that licensee at any time; this section imposes no post-payoff cooling-off period. Repeated completed loans can still consume income without being labeled renewals.
Before renewing, add every fee already paid to the next fee and the unchanged principal. Use the rollover calculator to show cumulative cost. If full payoff cannot coexist with rent, utilities, food and transportation, request the statutory extended payment plan by its deadline instead of assuming another renewal will solve the shortfall.
Next-business-day rescission and extended payment plan
A borrower may rescind without cost before the close of business on the next business day after the loan is made by returning the principal in cash or other immediately available funds. The lender must provide bold, capitalized notice of this right before disbursing funds. Obtain a dated receipt showing that the transaction and fee were cancelled.
Once during any consecutive twelve-month period, a borrower may request an extended payment plan. The written plan must be executed no later than the original due date and provide at least four equal payments over at least sixty days. The borrower’s obligation cannot exceed what was already owed, and the lender cannot add interest or plan fees except a permitted returned-check charge.
While the borrower complies, the lender cannot begin collection on that loan. Default permits termination and acceleration. Department guidance says the schedule must offer a reasonable repayment opportunity rather than front-load an unaffordable payment.
Licensing, online lenders and complaints
A person generally needs a license before making, offering or arranging an Idaho payday loan for a third-party lender. Certain supervised financial organizations and qualifying deposit-taking entities are exempt. Search the exact legal and trade names through Idaho Department of Finance and NMLS Consumer Access; a marketing name or logo alone is insufficient.
A payday loan made in Idaho in violation of the licensing requirement is void, uncollectible and unenforceable, with payment-recovery rights. Not every online installment product meets the payday definition, so obtain legal advice before withholding payment or answering litigation.
Idaho prohibits criminal-action threats and unfair or deceptive conduct. Collateral is limited to the borrower’s check. Preserve the advertisement, agreement, license result, income representation, debit authority, statements and messages; DFI warns that a written complaint may become a public record.
Idaho offer checklist and alternatives
Ask the biller about a due-date change or hardship plan. Compare credit-union or bank credit, employer assistance, utility relief and nonprofit counseling. Use the repayment-budget calculator with net income and essentials; the 25% gross-income ceiling is not a safe borrowing target.
- Identify the creditor, arranger, lead generator, servicer and every recipient of application data.
- Verify the lender or exemption by exact legal name through Idaho Department of Finance and NMLS.
- Confirm principal is no more than $1,000 and no more than 25% of gross monthly income.
- Record the fee per $100, dollar finance charge, APR, term, payoff and every debit attempt.
- Read the rescission deadline, renewal count, extended-plan notice and returned-payment provision.
- Save all disclosures, receipts, bank records, license results, complaints and company responses.

- Answer
Yes. Idaho permits payday loans from licensed or exempt providers under Idaho Code Title 28, Chapter 46, Part 4.
- Question 2What is the maximum Idaho payday-loan amount?
