Kansas payday-loan rules: the direct answer
Kansas permits payday loans made by licensed or supervised lenders under K.S.A. 16a-2-404. The cash advanced cannot exceed $500, the original term must be at least seven and no more than thirty days, and the charge cannot exceed 15% of the advance. A maximum-size example is therefore $500 received, a $75 finance charge and $575 due.
One lender and its related interests may have no more than two payday loans outstanding to the same borrower and may make no more than three to that person during any thirty-calendar-day period. These are lender-group limits, not evidence that a consumer qualifies or that every provider shown on a national form serves Kansas.
The offer cards below describe matching and referral services with published reviews. They are not findings that a particular Kansas-licensed lender is available. Identify the creditor in any response and verify that legal entity before sharing bank credentials or accepting an agreement.
What Kansas treats as a payday loan
The statute looks at substance: cash is advanced for a short period, one payment is anticipated, and the advance is no more than $500. A postdated check is common but not essential to the definition. Internet delivery, an electronic debit or different marketing language does not by itself move a single-payment cash advance outside the rule.
Kansas also prohibits devices designed to evade the section, including disguised sales or leasebacks. A person acting as a facilitator, conduit or agent for a third party in making a covered loan must obtain a supervised-loan license even when that third party claims an exemption from UCCC licensing. That makes the legal identity and role of every participant important on a referral page.
15% fee ceiling, payoff and APR examples
Apply the maximum charge to cash actually advanced. A $100 advance can carry up to $15 and require $115; $300 can carry $45 and require $345; $500 can carry $75 and require $575. The agreement should separately display the amount financed, finance charge, annual percentage rate and payment date under federal disclosure rules.
Because APR annualizes a brief fee, it can be high even though the dollar charge is fixed. Kansas OSBC illustrates a $100, fourteen-day advance with a $15 fee as 391.07% APR. The same ratio on $500 is also about 391% for fourteen days and about 183% for thirty days. These examples assume one payment and no default; use the actual dates and disclosed figures for a contract comparison.
For a $500 cash advance, 15% is $75 and the scheduled payoff is $575. Do not calculate the fee from the $575 payoff amount.
Term, open-loan and thirty-day limits
A Kansas payday-loan term must run from seven through thirty days. Count calendar dates from consummation to the contractual due date and confirm when an electronic debit will be submitted. A promise of instant or next-business-day funding describes processing, not the legally relevant repayment period.
The two-outstanding and three-in-thirty restrictions apply to the lender together with related interests. The lender must keep a borrower journal with identifying information and the dates each loan was made and became due. The agreement must prominently warn that related lenders cannot exceed two outstanding loans or split a requested amount into multiple contracts to increase fees.
Agreement and bilingual notices
Before the transaction is completed, the lender must provide the statutory notice in English and Spanish and the borrower signs or initials the appropriate version. The notice explains the two-open-loan rule, anti-splitting protection and extended payment plan. The agreement must present the plan’s availability prominently, not bury it behind a generic help link.
A screen showing only a possible range from a referral service is not the lender’s Truth in Lending disclosure and does not create an offer.
Cancel by the next business day
A borrower may rescind without cost by the end of the business day immediately following the transaction. The borrower informs the lender and returns the cash amount of principal; the lender must return fees already collected. This is a short deadline, so use the contract’s stated channel, office hours and instructions rather than relying on an unanswered general message.
Kansas extended payment plan
A borrower may request an extended payment plan before close of business on the last business day before the loan is due. The borrower and lender amend the agreement into at least four substantially equal installments. Payments align with regular income dates; without regular income they must be separated by at least two weeks.
No additional fee or interest accrues while the borrower complies, and early payment carries no penalty. The lender may exchange a held check for a new check reflecting the remaining balance after a payment. Default can accelerate the unpaid amount, and the borrower cannot obtain another payday loan from that lender while the plan remains open.
The statutory right is available once every twelve months with that lender, measured from payoff of the previous extended plan to entry into the next one. Request it before the deadline, preserve the signed amendment and compare each installment date with deposits and essential bills. A verbal promise to “work with you” is not a substitute for the documented plan.
After maturity, returned payments and collection
After maturity, the contract rate cannot exceed 3% per month of the loan proceeds. On $500, that ceiling is $15 per month. The statute otherwise bars extra charges except the extended-plan provisions and one permitted charge for a check returned because of insufficient funds. Review the agreement for the exact disclosed returned-check amount.
A lender cannot use or threaten criminal process to collect a payday loan. It also cannot attach a hold-harmless clause, confession of judgment or waiver of claims and defenses to the documents, or sell another product in connection with making or collecting the loan. Preserve collection messages, call times, bank entries and the signed contract if a charge or threat conflicts with those protections.
No same-lender payoff with new payday proceeds
The proceeds of a new payday loan from the same lender or a related interest cannot repay the existing payday loan, and they cannot be applied to another loan from that group. This blocks a fee-based refinancing sequence that merely replaces the old balance. It also reinforces why related legal entities matter more than different storefront or website names.
Licensing, online companies and complaints
The Kansas Office of the State Bank Commissioner licenses supervised lenders, including payday lenders, through NMLS. Search NMLS Consumer Access using the exact company name and any NMLS identifier in the agreement; compare address, trade names and current status. A matching-service brand and the eventual creditor may be separate companies requiring separate analysis.
Some online entities claim tribal ownership or another exemption. OSBC explains that it lacks jurisdiction over entities wholly owned by a tribe, while also cautioning that not every company asserting tribal status is wholly owned. Do not decide the issue from a footer statement. Submit the documents so the regulator can assess identity and jurisdiction.
OSBC recommends contacting the company first and collecting dates, amounts, agreements, statements and correspondence. Its complaint process covers payday lenders and finance companies but the office cannot serve as private counsel or adjudicate a contract. Use the regulator’s current form and keep unnecessary Social Security, bank-account and card numbers out of ordinary attachments.
Kansas offer checklist and alternatives
Before using high-cost credit, ask a creditor or utility for a due-date change, compare a bank or credit-union small-dollar product, check employer or community assistance and consider nonprofit credit counseling. Enter actual cash received, fee and days into the cost calculator; then use the budget-margin calculator to test whether repayment leaves a realistic cushion.
- Identify the referral brand, facilitator, legal lender, servicer and every recipient of application data.
- Verify the exact lender and facilitator through Kansas OSBC and NMLS Consumer Access.
- Confirm principal no higher than $500, a fee no higher than 15% and a term from seven to thirty days.
- Count outstanding and recent loans from the lender and related interests without assuming statewide eligibility.
- Save the bilingual notice, APR disclosure, rescission method, extended-plan instructions and debit authorization.
- Compare the scheduled payoff with essential expenses and document any complaint with dates and records.
