Maine payday-loan rules: the direct answer
Maine recognizes a payday loan as a supervised loan or other consumer-credit transaction in which a cash advance is exchanged for a personal check or authorization to debit a deposit account on a future date. The definition is in Title 9-A, but Maine does not present one simple $500-style payday principal ceiling in the provisions reviewed for this guide. Instead, the cost depends on the product, the amount financed, the permitted finance charge and the contract disclosures.
The Maine Bureau of Consumer Credit Protection (BCCP) says payday lenders must hold a Maine license. Its consumer guide explains that a payday loan of $250 or more may carry a maximum $25 fee under the minimum-charge rule, even though a typical two-week $250 example works out to about 260% APR. That exception is why a headline “30% cap” should never be used without checking the minimum charge, actual days and amount financed.
The offer cards below are national matching or referral services with separate reviews. They are not evidence that a named company is a Maine creditor, broker or licensed payday lender. Treat an online response as a lead until the legal lender, Maine authority, price and repayment agreement are identified.
What Maine calls a payday loan
Title 9-A §1-301(28-A) focuses on the payment instrument and delayed presentment: the consumer receives cash, gives a personal check or deposit-account debit authorization, and the parties agree that payment will wait until a future date. A page advertising “cash advance,” “same-day money” or “bad-credit installment” may still be a consumer loan subject to Maine law when its substance fits the code.
Maine’s territorial rule is important for internet borrowing. A consumer-credit transaction is made in Maine when a creditor, wherever located, enters into it with a consumer located in Maine. For a resident, a contract cannot simply replace Maine protections with a different state’s law when the Maine code applies. Check the residence and the governing-law language before accepting a remote signature request.
Finance-charge tiers and the minimum-charge exception
For a closed-end consumer loan, Title 9-A §2-401 permits an actuarial finance charge up to 30% per year on the unpaid balance up to $2,000, 24% on the portion above $2,000 through $4,000, and 18% on the portion above $4,000. When the amount financed exceeds $8,000, the statute limits the entire loan to 18% per year. These are annualized finance-charge ceilings, not a promise that a borrower will qualify or that a lender will price at the maximum.
The same section allows a minimum finance charge of up to $5 when the amount financed does not exceed $75, $15 when it is more than $75 but less than $250, and $25 when it is $250 or more. A $250 loan with a $25 charge held for fourteen days illustrates the issue: the fee alone annualizes to roughly 260% before any other permitted item is considered. Ask whether the quote uses principal, net proceeds or another amount as the denominator.
A $25 minimum charge on a $250, fourteen-day transaction is about 260% annualized. Compare the written finance charge and APR, not a “small fee” description.
Term, payment schedule and refinancing
The BCCP consumer guide says most payday loans have terms of about two weeks, but that description is educational rather than a universal statutory term. The agreement should show the delivery date, presentment or debit date, finance charge and APR.
For supervised loans of $1,000 or less that are payable in more than one payment, §2-308 generally requires substantially equal installments at equal intervals, with an allowance for seasonal or irregular income, and a maximum schedule of 25 months. A lender proposing a different structure should explain the product category and legal basis. A refinancing must use the finance-charge rules that apply to the resulting amount; a new form is not automatically a cheaper extension.
Written disclosures and the real payoff
Maine’s consumer education material states that state and federal Truth in Lending rules require the finance charge and APR in writing. Save the disclosure before authorizing a debit. Compare the amount financed with the cash that reaches the bank account, then add every required charge, optional product, late amount, return-payment charge and broker fee.
Use the actual number of days when estimating annualized cost. A two-week minimum charge can look dramatically different from a 30-day installment schedule even when the dollar fee is identical. If a lender says it is merely a broker, request the broker disclosure, the creditor’s legal name and the destination of application data before completing an account-linking step.
BCCP licensing and out-of-state lenders
The BCCP supervised-lender page includes payday lenders among the license category. It says a person who makes, takes assignment of or services a consumer loan with an actuarial finance charge above 12¼% per year, or a loan secured by real estate, needs a supervised-lender license. Applications and renewals use the Nationwide Multistate Licensing System (NMLS). Search the exact legal name, trade name, address and NMLS identifier shown in the agreement.
Maine’s supervised-lender FAQ says an out-of-state supervised lender may operate without a physical Maine office when it holds a BCCP license. The same FAQ says a lender must follow the law of the consumer’s principal residence. Therefore, a remote website, tribal assertion or out-of-state mailing address is not a substitute for checking Maine authority and Maine pricing.
Online matching, data sharing and bank debits
A lead generator may collect an application and send it to several lenders, brokers or marketing partners. Read consent language for credit-report access, recurring contact, account verification, data sharing and electronic-signature records. The company named in a text message may differ from the creditor in the contract. Keep screenshots of the URL, consent screen, offer and confirmation emails.
Do not assume instant funding means instant availability in Maine. A match can fail a lender’s underwriting, a state eligibility rule or an internal product restriction. Before granting ACH authority, ask whether the debit is one-time or recurring, how to revoke it, and which party will handle a failed payment. A successful form submission is not proof of an affordable loan.
Unlicensed activity, collections and complaints
BCCP warns that many illegal high-cost loans reach Maine consumers through unlicensed internet lenders. Verify the license before paying an upfront fee or sending a copy of a driver license. Keep the contract, bank records and collection messages if a company changes the payoff, threatens arrest, refuses to identify the creditor or continues debits after a written stop request.
Maine residents can submit a complaint to the BCCP about a supervised lender, loan broker, loan servicer and other regulated entities. The Bureau can review regulatory compliance but is not a consumer’s attorney. The complaint form asks for the business, account, facts, requested resolution and supporting copies; do not mail original documents. Call 800-332-8529 in Maine or 207-624-8527.
Alternatives and a Maine borrowing checklist
Use the Borrow Radar cost calculator with the actual amount deposited and the exact payoff date, then test the payment against rent, food, utilities, transportation and existing debt. A nonprofit counselor or local assistance program may solve the immediate gap without a new debit authorization. If the proposed price cannot be understood from one complete agreement, pause and request the missing disclosure.
- Identify the referral company, broker, legal creditor, servicer and every organization receiving application data.
- Search the BCCP licensee database and NMLS using the exact legal name and any Maine license number.
- Separate amount financed, money deposited, minimum charge, APR, due date, debit authority and all optional fees.
- Check whether a multi-payment loan of $1,000 or less follows the equal-installment and 25-month schedule rule.
- Save the signed agreement, Truth in Lending disclosure, consent record, payment receipts and collection messages.
- Ask a biller, employer, bank or credit union about a hardship extension or small-dollar alternative before accepting a two-week obligation.
Maine payday-loan FAQ
- Question 1Are payday loans legal in Maine?
- Answer
Maine law defines payday loans and the BCCP licenses payday lenders. A transaction must fit the Maine Consumer Credit Code, use the required disclosures and comply with applicable finance-charge and licensing rules.
- Question 2What is the maximum payday-loan amount in Maine?
- Answer
The provisions reviewed for this guide do not state one simple universal payday principal ceiling like $500. The amount, product category, finance charge and disclosures must be evaluated together under Title 9-A and the lender’s Maine authority.
- Question 3What fee can a Maine payday lender charge?
- Answer
Title 9-A §2-401 allows minimum finance charges up to $5 for amounts through $75, $15 for amounts above $75 and below $250, and $25 for amounts of $250 or more. The written APR and all other charges still control the comparison.
- Question 4Does Maine apply its rules to online lenders located elsewhere?
- Answer
Yes. Maine’s territorial rule applies when a creditor, wherever located, enters a consumer-credit transaction with a consumer located in Maine. The BCCP also says an out-of-state supervised lender may operate without a Maine office if it holds a Maine license.
- Question 5Where can a Maine resident complain about a payday lender?
- Answer
Submit a complaint to the Maine Bureau of Consumer Credit Protection, using its online form or mailing a copy to 35 State House Station, Augusta, ME 04333. The Bureau lists 800-332-8529 and 207-624-8527 for assistance.
