Massachusetts payday-loan rules: the direct answer

Massachusetts does not ban the words “payday loan,” but the Division of Banks explains that the high annual percentage rate normally attached to the product is illegal. A company or individual making a small-dollar loan to a Massachusetts resident must follow the state small-loan law and obtain the required license when interest and expenses exceed the statutory threshold. A national web form can therefore be visible in Massachusetts without the resulting high-cost contract being lawful.

For a personal, family or household loan of $6,000 or less, General Laws chapter 140, section 96 treats more than 12% a year in combined interest and expenses as the trigger for small-loan licensing. The current Small Loans Regulatory Board rate order in 209 CMR 26.01 permits a licensed business to charge up to 23% per year on unpaid balances plus a $20 administrative fee when a loan is granted; that administrative fee may be assessed only once in a twelve-month period.

The offer cards on this page are national matching or referral services with their own reviews. They are not Massachusetts licensees merely because they accept a ZIP code. Treat a result as a lead until the actual creditor, broker, servicer, license, amount financed, complete APR and debit authority appear in documents you can save.

The 12% licensing threshold and 23% rate order

Section 96 is easy to misread as a simple 12% price cap. It is primarily a licensing rule: a person making a loan of $6,000 or less with interest and expenses above 12% annually must be licensed by the Commissioner of Banks. The statute also counts brokerage, commissions, services, extensions, forbearance and sums paid to another party when the lender knew or reasonably could have known about them. A “broker fee” cannot automatically sit outside the calculation.

Within the licensed small-loan framework, 209 CMR 26.01 sets a maximum charge of 23% per annum on unpaid balances calculated actuarially, plus a $20 administrative fee at origination no more than once per borrower in twelve months. The order limits the post-maturity rate to 6% after one year and allows a returned-check charge of up to $10 when the contract permits it. Do not add an invented application or membership fee.

Massachusetts cost check

A two-week offer quoting a triple-digit APR is not a normal Massachusetts small-loan quote. Request the lender’s license and a complete disclosure showing the amount actually received, every charge, APR and payoff date.

Online, out-of-state and tribal lending still reaches Massachusetts

Massachusetts law says an application made by a person in the Commonwealth can be treated as a loan made in Massachusetts even when money is advanced from outside the state. Section 96 also covers a person who negotiates, arranges or assists in procuring a small loan for compensation, so calling a website a marketplace does not settle its licensing status.

The Division has repeatedly warned about online and tribal lenders that advertise high-rate products to Massachusetts residents. A tribal name, a foreign mailing address, an arbitration clause or a statement that the lender follows another state’s law is not proof that Massachusetts protections disappear. Ask which entity funds the money, who receives the fee, where the company is licensed and which regulator handles a complaint before granting permission to debit a bank account.

APR, amount received and the real repayment date

Compare the amount financed with the net cash deposited. Section 96 says that if deductions made around origination leave the borrower with $6,000 or less, the transaction is treated as a loan for the amount retained. That prevents a contract from disguising a small advance behind a larger nominal principal. Ask for a Truth in Lending disclosure before signing and keep the final agreement, payment schedule and consent record.

A fourteen-day promise can hide a full debit on the next payday, a retry fee, a rollover invitation or an optional service. Write down the exact due date and test it against rent, utilities, food, transport and other automatic payments. If a lender presents only an “up to” range or says a partner will reveal the price later, the page has not shown enough information to compare affordability or Massachusetts compliance.

How to verify a Massachusetts lender or broker

The Division of Banks licenses consumer finance companies, including small-loan companies, through the Nationwide Multistate Licensing System. Use the exact legal name, trade name, city, NMLS identifier or license number in the contract. A search result should show Massachusetts authority for the relevant activity, not merely a registration in another state. Also identify any broker, lead seller and servicer because separate participants may have different responsibilities.

Massachusetts publishes a quarterly list of approved licensees and provides a free NMLS verification route. Save the result with the date checked. If the website refuses to identify its creditor, asks for an upfront fee before showing terms, or uses a different company name for an ACH debit, pause and contact the Division rather than relying on a logo or a “licensed partner” badge.

Unlicensed loans, collections and possible remedies

General Laws chapter 140, section 110 states that a loan made by an unlicensed person in violation of the small-loan provisions is void. The Division also explains that collecting an illegal Massachusetts loan is unlawful. That does not mean a borrower should ignore every demand: preserve the contract, payment history, bank statements, emails, texts and caller details, then obtain individual legal advice before disputing a balance or closing an account.

If a collector will not identify the creditor, changes the balance without an accounting, threatens arrest or continues an ACH debit after a written stop request, document each event. Ask the bank about its debit-stop process and ask the company for a written payoff history. The state remedy depends on facts such as licensing, amount, product, dates and exemptions, so use the statute and a qualified adviser rather than a social-media template.

Application data, credit checks and recurring debits

Matching sites can distribute one application to multiple lenders and marketing partners. Before pressing submit, read permission for a hard or soft credit inquiry, bank-account verification, recurring calls or texts, electronic signatures and sale or sharing of personal information. Save the privacy notice and consent screen.

An ACH authorization should say whether the debit is one-time or recurring, the amount or method used to calculate it, the date window, retry policy and revocation method. Do not provide online-banking credentials when a safer verification option is available. Funding speed is an estimate, not approval, and a successful match does not establish that the creditor is licensed or that the price fits the 23% rate order.

Massachusetts verification and complaint steps

The Division of Banks Consumer Assistance Unit accepts complaints about financial products and can explain its jurisdiction, but it cannot act as your lawyer or guarantee a refund. Its published contact information includes 800-495-BANK (2265) and 617-956-1500. Use the Borrow Radar cost calculator with actual net proceeds and the payoff date, then test whether a realistic emergency buffer remains.

  1. Record the referral brand, legal creditor, broker, servicer, physical address, NMLS identifier and every company named in the consent or debit authorization.
  2. Search the Division of Banks license tools and the NMLS record using the exact legal names, not only the advertising brand.
  3. Compare amount received, principal, APR, 23% rate-order calculation, $20 administrative fee, returned-payment charge, term and all third-party compensation.
  4. Save the signed agreement, Truth in Lending disclosure, privacy notice, consent, account-linking confirmation, payment receipts and collection messages.
  5. Contact the provider first in writing and keep a dated copy. Then submit the facts and supporting copies to the Division of Banks if the response is missing or unresolved.
  6. For a cash shortfall, ask a biller, employer, bank or credit union about a payment arrangement or lower-cost small-dollar option before authorizing a two-week debit.

Massachusetts payday-loan FAQ

Question 1Are payday loans legal in Massachusetts?
Answer

Massachusetts does not prohibit the label itself, but the Division of Banks says the high APR normally charged by payday loans is illegal. Any lawful small-dollar product must fit the state licensing, rate, fee and disclosure rules.

Question 2What rate can a Massachusetts small-loan company charge?
Answer

The Small Loans Regulatory Board rate order in 209 CMR 26.01 permits up to 23% per year on unpaid balances plus a $20 administrative fee at origination no more than once in twelve months, with other charges limited by law and the written contract.

Question 3When does a Massachusetts lender need a small-loan license?
Answer

For a personal, family or household loan of $6,000 or less, chapter 140 section 96 requires licensing when combined interest and expenses exceed 12% annually. The calculation can include brokerage, commissions, services and payments to other parties.

Question 4Can an out-of-state or tribal website lend to a Massachusetts resident?
Answer

An out-of-state location does not settle the issue. Massachusetts treats an application made by a person in the Commonwealth as a Massachusetts loan, and the Division has warned about online and tribal high-rate lending. Verify the actual creditor and Massachusetts authority.

Question 5Where can I report a Massachusetts payday-loan problem?
Answer

Contact the Massachusetts Division of Banks Consumer Assistance Unit at 800-495-BANK (2265), or use its online complaint process. Include the legal company, account, timeline, requested resolution and copies of records rather than original documents.
