Nebraska payday-loan rules: the direct answer
Nebraska permits a licensed delayed deposit services transaction, the state’s statutory name for a payday advance. The Nebraska Department of Banking and Finance (NDBF) licenses and supervises these businesses under the Delayed Deposit Services Licensing Act, sections 45-901 through 45-931. The product is capped at $500 in total, including fees and charges from one lender, and the current annual percentage rate (APR) ceiling is 36%.
The law also limits a licensee to two checks from one maker at a time and an aggregate face amount of no more than $500. A check generally cannot be held longer than 34 days. A written notice must show the transaction amount, due date, total payment, fees in dollars and APR, deposit date and any penalty. The notice must explain the next-business-day rescission right and the right to cancel electronic-payment authorization.
The offer cards below are national matching and referral services with full reviews. They are useful for comparing disclosures and data practices, but they are not a list of NDBF licensees. A marketplace can accept a Nebraska ZIP code without finding a licensed creditor or a product that fits the 36% cap. Identify the actual lender, license, amount financed, fee, APR, due date and payment method before providing sensitive information.
Nebraska licensing, branches and online lenders
Every business engaging in payday-lending services in Nebraska must hold a delayed deposit services business license. A license covers the main location only; each branch requires a separate application. The NDBF application process includes a surety bond, biographical and financial information, publication and possible hearing. Licenses issued after January 1, 2021 remain effective until the next December 31 and are renewed through the Nationwide Multistate Licensing System.
The state licensing requirement follows the activity, not the website’s branding. An out-of-state company that offers, arranges or collects a Nebraska delayed-deposit transaction may still need the Nebraska license. Use the NDBF search and NMLS Consumer Access to check the legal company named in the agreement. A lead generator, payment processor or “technology partner” may not be the creditor, so record every entity shown in the privacy and electronic-consent screens.
36% APR cap and the $500 all-in limit
Nebraska Revised Statute §45-918 prohibits an APR above 36% for a delayed-deposit transaction. A transaction made in violation is void, and the unlicensed or noncompliant provider has no right to collect or retain principal, interest, fees or other charges. The APR definition includes fees, interest and charges in the delayed-deposit contract, except limited returned-item charges. Compare the amount received with the total amount due, not simply a quoted “service fee.”
The required notice says the transaction cannot be more than $500 in total, including fees and charges, from one lender. A licensee also cannot hold more than two checks from one maker or more than $500 in aggregate face amount. These are lender-level limits, so a second brand owned by the same company should not be assumed to create another $500 allowance. Ask how affiliated entities are treated before signing a second form.
A fee schedule from an older brochure may show a historical per-$100 charge, but the current 36% cap controls the price of a new transaction. Use a calculator to annualize the exact fee and days, then compare it with the APR printed in the agreement. Active-duty service members, spouses and dependents also receive the federal Military Lending Act protection referenced in §45-918.
The advertised advance is not the ceiling. Confirm that the total check or authorized debit, including every contract fee, stays within $500 and that the disclosed APR is 36% or less.
Rescission, redemption and electronic-payment control
Nebraska gives a maker the right to rescind before 5:00 p.m. on the next business day after the delayed-deposit transaction. Before the check is negotiated or presented, the maker may also redeem it by paying the full amount. The written notice must explain these rights in plain language. Follow the agreement’s delivery instructions, keep a timestamped receipt and ask the lender for written confirmation that the transaction is closed.
A licensee may use an electronic transfer or withdrawal only with the maker’s written authorization and may not charge an additional finance charge for receiving proceeds in a non-cash form. The notice also gives the consumer a right to rescind the electronic-payment authorization. Review the authorization for the exact date, amount and account, and do not assume that a recurring debit permission is unlimited. Tell the lender in writing if the authorization is withdrawn.
Holding period, repayment and no fee-only rollover
A licensee may not hold or agree to hold a check for more than 34 days, subject to a narrow collection exception when the item was not negotiable on the agreed date. The licensee cannot renew, roll over, defer or extend the transaction by accepting less than the full check and authorized charges. A shorter original term may be extended without an additional fee at the maker’s request, but the statutory holding limit and written proof requirements still apply.
Returned checks and the extended payment plan
For a returned check, the licensee may collect the face value through civil means and one returned-check charge of no more than $15 for that transaction, plus court costs and reasonable attorney fees awarded by a court. No other default fee may be collected, and the returned-check charge is not allowed when forgery or theft caused the dishonor. Request the transaction ledger and the contractual basis for each amount claimed.
If the maker cannot pay by the due date, Nebraska provides an extended payment plan that may be elected once in any twelve-month period. The request must be made before the due date and documented in an amendment. The plan must allow at least four equal payments that coincide with the maker’s pay dates, with no additional interest or fees during the plan; the maker may prepay without penalty. Read the amendment carefully and keep the fully executed copy.
Prohibited practices and online data sharing
Nebraska prohibits loan-brokerage, insurance and ancillary-product charges that would push a maker above the Act’s limits. A licensee cannot require a payment method that creates extra charges, accept collateral or disguise proceeds as a sale, leaseback or rebate. It also cannot use deceptive advertising or arrange a transaction that evades the 36% APR rule. A demand for an upfront “release,” “verification” or “insurance” payment should end the application.
Read the privacy policy for lender partners, credit-report inquiries, bank-connection tools and recurring ACH permissions. Because the creditor may be different from the brand that collected the form, ask who will store documents, who can debit the account and how to revoke authorization. NDBF can address license and Act violations; the Federal Trade Commission and CFPB may handle other deceptive or data-related conduct.
A practical Nebraska verification checklist
Borrow Radar calculators estimate APR and repayment margin, but they do not verify a license or decide whether a transaction is legal. Treat a matched result as an invitation to inspect the documents. A Nebraska comparison is complete only when the named creditor, rate, total due, dates and payment authority are all visible and consistent.
- Search the legal creditor in NDBF resources and NMLS Consumer Access; do not rely only on the marketplace name or a “partner lender” label.
- Confirm the written notice lists the amount, due date, total payment, fee in dollars, APR, deposit date, penalty and electronic-payment rights.
- Check that the total transaction is $500 or less, the lender holds no more than two checks totaling $500 and the check is not held beyond 34 days.
- Calculate the all-in APR and reject any proposal above 36%, any hidden brokerage or insurance charge, or any fee-only rollover.
- Mark the next-business-day rescission deadline and the payment-authorization cancellation right; keep proof of any request or payoff.
- If the due date will displace essentials, request the one-per-twelve-month extended plan before the due date or seek a bill arrangement, credit-union product or nonprofit counseling.
Nebraska payday-loan FAQ
- Question 1What is the maximum payday-loan amount in Nebraska?
- Answer
A delayed-deposit transaction cannot exceed $500 in total, including fees and charges, from one lender. A licensee may hold no more than two checks from one maker and no more than $500 in aggregate face amount.
- Question 2What APR can a Nebraska payday lender charge?
- Answer
Nebraska Revised Statute §45-918 caps the APR for a delayed-deposit transaction at 36%. A transaction above that cap is void and the provider has no right to collect principal, interest or fees.
- Question 3Can a Nebraska payday loan be rolled over?
- Answer
Not by paying only part of the check or a fee. Nebraska prohibits renewals and rollovers, although a maker may request a no-additional-fee extension within the holding limit or elect the statutory extended payment plan before the due date.
- Question 4How quickly can I cancel a Nebraska delayed-deposit loan?
- Answer
You may rescind before 5 p.m. on the next business day after the transaction. Before the check is presented, you may also redeem it by paying the full amount. Keep written proof of the request and payoff.
- Question 5Where can I report a Nebraska payday-lender problem?
- Answer
Contact the Nebraska Department of Banking and Finance and use its delayed-deposit complaint process. Include the creditor’s legal name, license information, agreement, timeline, payment records and screenshots of the online form.
