North Dakota payday-loan rules: the direct answer

As of August 27, 2026, North Dakota permits a deferred-presentment service transaction through a provider licensed by the Department of Financial Institutions (DFI). The legal model can use a post-dated check, a check held for later presentment or an electronic authorization to withdraw funds on an agreed future date. A comparison site, lead form or brand name is not the lender license; verify the final legal entity before entering banking information.

The actual loan proceeds may be no more than $500, while the customer’s total outstanding payday obligation with a licensee may not exceed $600. The service fee is capped at 20% of the amount paid to the customer. A separate database charge may be passed through only to the extent permitted by the statute. These limits describe a licensed deferred-presentment transaction, not every online installment or line-of-credit product using “payday” language.

The initial deferral and one renewal together cannot last more than 60 days, and an individual renewal period must be at least 15 days. North Dakota also offers no-cost next-business-day rescission and permits a voluntary workout agreement in qualifying circumstances. Compare the written agreement with these rules rather than treating an advertised “instant” amount as a guaranteed approval.

DFI licensing and online provider verification

North Dakota Century Code §13-08-02 requires a license to provide deferred-presentment services, with a separate license for each location. The DFI FAQ explains that a provider is considered to be conducting the activity when the customer is located in North Dakota, and a physical storefront is not required for an online license. A national website therefore cannot rely on an out-of-state address alone.

DFI participates in the Nationwide Multistate Licensing System (NMLS) and directs consumers to NMLS Consumer Access to determine whether a company or individual is licensed. Search the exact legal name from the agreement, not only the marketing name in an advertisement. Match the license record to the creditor, servicing company, payment processor and any broker that collected your application.

North Dakota also licenses money brokers and other non-depository businesses. A broker may arrange credit without being the creditor that funds the transaction. Ask which entity owns the debt, which entity receives the check or ACH authority, and where complaints should be sent. Save the domain, privacy notice, consent language and final disclosures so the chain of responsibility remains clear if the application is forwarded.

The 20% fee, $500 proceeds and $600 aggregate ceiling

A North Dakota licensee may charge a deferred-presentment service fee of no more than 20% of the amount paid to the customer. The fee is not treated as interest for purposes of the chapter, but it still increases the dollars required to close the transaction. On $300 of proceeds, the maximum service fee is $60; on $500, it is $100. Ask whether the amount shown is gross check value, net cash received or total payoff.

The only additional charge expressly described in the core rule is a permitted database-registration fee, limited to the licensee’s actual cost. A provider should not add an unexplained verification, membership, insurance, release or instant-transfer amount. Require a dollar-by-dollar schedule before authorizing a debit, and use the actual days outstanding to understand the annualized cost without mistaking an estimate for a statutory APR quote.

The DFI FAQ states that one person may have no more than $600 in aggregate outstanding payday obligations, of which $500 is actual loan proceeds. A new application cannot be used to exceed that ceiling. Include balances at other licensed providers when asking about eligibility, and do not assume a different URL or affiliate resets the North Dakota limit.

Term, renewal, repayment and rescission rights

A licensee may renew a deferred-presentment transaction no more than once. The renewal fee cannot exceed 20% of the amount renewed, must be paid in the permitted form, and the total period including the original deferral and renewal cannot exceed 60 days. An individual renewal period must be at least 15 days. After that period, the transaction must be paid off rather than carried forward indefinitely.

A borrower can redeem a check or repay an electronic transaction at any time before the agreed presentment date. North Dakota gives the customer a right to rescind at no cost by the close of the business day following the day payment is received. For electronic funding, the provider must facilitate repayment through the same electronic means used to deliver the funds. Request written confirmation that the agreement and debit permission are closed.

A voluntary workout agreement may be available when the borrower believes the balance cannot be paid on time, but the provider is not required to accept one. A licensee may not renew, repay, refinance or consolidate one deferred-presentment transaction with proceeds from another such transaction. Ask for a written payoff, workout terms and database status instead of taking a second advance to cover the first.

Payment controls, collateral and collection protections

North Dakota prohibits a licensee from taking property, a title or a mortgage as a condition of a deferred-presentment transaction or as a collection method without proper civil process. A provider that requests a vehicle title for a payday check is describing a different risk and should be questioned. The statute also says no extra fee or charge may be collected because a check or electronic debit is returned or because the customer defaults, beyond charges the law expressly permits.

The agreement should show the amount paid, the fee in dollars and the maturity date, and authorize the check presentment or electronic debit only until a specified date. Internet customers must acknowledge the fees through a click-through or similar process before completing the transaction. Keep the fee screen and agreement together; a later portal summary may omit the original disclosures.

A customer who had authority to issue the check or authorize the debit is not subject to a criminal penalty merely because the deferred-presentment transaction failed. That does not erase a lawful civil balance, but threats of arrest, badges, fake court papers or demands for gift cards are collection-scam indicators. Contact your bank quickly about an unauthorized withdrawal and preserve every message.

North Dakota borrower verification checklist

Borrow Radar calculators can model the 20% fee, total payoff and renewal path, but they do not establish a provider’s North Dakota license or predict approval. Compare the cash received with the amount withdrawn, and budget for the full payoff without assuming a renewal. If the repayment would require another loan, consider a credit union, employer advance, nonprofit emergency fund or bill extension first.

  1. Identify the legal creditor, servicer, broker and payment processor; verify the exact provider in NMLS Consumer Access or DFI records.
  2. Confirm actual proceeds do not exceed $500, total outstanding payday obligations stay within $600 and the service fee is no more than 20% of proceeds.
  3. Check the maturity date, one-renewal limit, minimum 15-day renewal period and 60-day maximum including the original deferral.
  4. Read the dollar fee, database charge, check or ACH authorization, no-cost next-business-day rescission instructions and any voluntary workout language.
  5. Reject title or mortgage collateral, upfront release payments, unexplained membership charges, guaranteed approval and criminal-threat collection calls.
  6. If a debit or contract is disputed, notify the bank and submit a signed complaint to DFI with the agreement, screenshots, statements and a dated timeline.
