Ohio short-term loans: the direct answer
Ohio authorizes licensed short-term loans under sections 1321.35 through 1321.48 of the Ohio Revised Code. The post-2018 structure is not the classic unrestricted two-week payday model. A covered short-term loan may not exceed $1,000, normally runs from 91 days to one year, and must use a written contract with state-required disclosures and repayment protections.
A shorter duration is possible only when the total monthly payment stays within the statute’s income-based test: no more than 6 percent of verified gross monthly income or 7 percent of verified net monthly income, whichever is greater. The lender must hold an Ohio short-term-loan license unless a statutory exemption applies.
Advertisements frequently use payday, cash advance, emergency loan and personal loan as overlapping labels. Ohio residents should classify the final document by the legal creditor and license, not by the search phrase. A referral service may assist with a request, but section 1321.36 also requires a license for a person making, offering, brokering or assisting an Ohio borrower to obtain a covered short-term loan.
Interest, maintenance and origination charges
Section 1321.40 permits annual interest up to 28 percent for the short-term-loan product. It also allows a monthly maintenance fee capped at the lesser of 10 percent of the original loan amount or $30. A $500-or-more loan may include a 2 percent origination charge. Those separate amounts must be included when calculating the annual percentage rate even though the statute defines and limits them individually.
Ohio also imposes an overall ceiling in section 1321.403: total fees and charges connected with a short-term loan generally cannot exceed 60 percent of the originally contracted amount. That outer limit should not be confused with the price of every loan. The contract may cost less, and a borrower should compare the exact APR, total of payments and dollar charges rather than treating the ceiling as standard pricing.
A permitted check-collection charge can be up to $20 plus an amount passed through from another financial institution, and a lender issuing proceeds by check may charge up to $10 to cash that check. The contract must identify applicable charges. The borrower’s bank can impose its own separate fee when an attempted payment fails.
Term, payment test and cancellation right
The written schedule matters more than a promise of a low periodic payment. Review the original amount, number of installments, maintenance fees by month, interest, origination charge and final payoff. A longer term can reduce one installment while increasing the number of maintenance charges. Prepayment is therefore worth modeling because the Short-Term Loan Law prohibits a fee for paying the loan in full early.
The agreement must state the right to rescind or cancel by returning the originally contracted loan amount by 5 p.m. on the third business day immediately following the day the contract is entered. Preserve proof of delivery and obtain a receipt if that right is used. Do not assume that merely closing a browser window cancels an executed contract.
Ohio prohibits a short-term licensee from taking a vehicle title, real estate or other physical asset as collateral for this obligation. It also restricts demand features, misleading advertising and unauthorized electronic drafts. A contract that presents the loan as title-secured or gives the lender broader collection rights needs a different legal explanation and should not be accepted as a routine Short-Term Loan Law transaction.
Outstanding-loan and collection safeguards
A licensee generally cannot make another short-term loan while the borrower has an outstanding loan with that licensee, a commonly controlled person, or its employee or agent. Ohio also bars a new transaction that would put the borrower above $2,500 in outstanding principal across short-term loans from licensees. The borrower signs an eligibility declaration, and the lender must make a concerted verification effort.
After two consecutive electronic collection attempts fail, section 1321.411 requires new written authorization before another account attempt. This rule can reduce repeated debit damage, but it does not cancel the unpaid obligation. Save bank statements and authorizations, and contact the lender before the next date if the schedule cannot be met.
A lender cannot threaten a criminal action solely because a payment instrument was returned for insufficient funds when the borrower has not engaged in fraud. Debt-collection communications remain subject to detailed state restrictions. Keep a timeline of calls, messages, payment attempts and the party servicing the account if a complaint becomes necessary.
Checking an online Ohio loan or matching service
Search the creditor or broker through the Ohio Division of Financial Institutions license lookup. Match the business name, address and credential to the agreement. If the application begins on a national marketplace, do the search again after the actual creditor appears. An enabled form and the absence of Ohio from a disclosure list do not prove that the company holds the required authority.
Compare the marketplace description with the lender’s contract. National referral services tracked by Borrow Radar publish broad product ranges, some of which do not resemble Ohio’s covered short-term-loan limits. A participating lender may offer a different compliant product, decline the request or route it outside the advertised payday category. Only the final written offer answers that question.
Do not send a “release,” insurance or verification payment before receiving loan proceeds. Avoid gift cards, cryptocurrency, remote-device access and requests to move money for a supposed lender. A licensed loan’s charges belong in the written disclosures, and unusual payment instructions should be independently reported or verified.
A better Ohio comparison than “cash today”
Build a dated cash-flow comparison. Add the reliable income arriving before each installment, then subtract housing, food, transport, utilities, insurance, medicine and existing debt payments. Enter the proposed installment last. If the result is negative or depends on another advance, the loan does not solve the timing problem even if the first payment passes the statutory percentage test.
Ask the original payee about a short extension, due-date change or hardship arrangement. Compare its written fee and consequence with the proposed origination, maintenance and interest charges. Credit unions, community banks, employers and nonprofit programs may offer a smaller-dollar schedule. Ohio 211 can help locate local support for essential expenses.
Borrow Radar lists active reviewed services as places to compare disclosures. The matched company must still hold the required Ohio authority and present a contract that satisfies the Short-Term Loan Law or another applicable lending statute.
Ohio short-term-loan FAQ
- Question 1What is the Ohio Short-Term Loan Law maximum amount?
- Answer
A loan made under sections 1321.35 through 1321.48 may not exceed $1,000. A different consumer-loan product may be governed by another Ohio statute, so verify the license and contract classification before applying that limit.
- Question 2Is the Ohio short-term-loan rate simply 28% APR?
- Answer
The law permits interest up to 28 percent annually plus specifically limited maintenance, origination and certain payment-related charges. The APR disclosure must account for applicable charges, and total fees and charges are subject to a separate statutory ceiling.
- Question 3How long is an Ohio short-term loan?
- Answer
The ordinary range is at least 91 days and no more than one year. A shorter term can be used only when the total monthly payment meets the verified-income percentage test stated in section 1321.39.
- Question 4Where can an Ohio lender be checked or reported?
- Answer
Use the Ohio Division of Financial Institutions license lookup for the legal entity. Its Office of Consumer Affairs accepts written complaints with copies of the contract, payments, communications and other supporting records.
