Rhode Island payday-loan rules: the direct answer
As of August 27, 2026, Rhode Island permits a deferred-deposit transaction, the statutory payday-loan model, when made by a licensed check casher. A valid check-casher license may use the carve-out instead of a separate small-loan license. A web form, referral brand or out-of-state address does not prove Rhode Island authority.
The deferred-deposit rules limit the customer’s check to $500, require a term of at least 13 days and cap the deferred-deposit fee at 10% of the funds advanced. The written agreement must state the fee in dollars and as an APR, identify a specific deposit date and provide a duplicate original. A licensee may hold no more than $500 in checks from one customer, no more than three checks at the same time and may permit only one rollover.
Rhode Island enacted 2025 legislation that repeals the deferred-deposit section and removes its special fee provision effective January 1, 2027. That scheduled change matters for any agreement made near year-end: the 2026 summary below is a dated snapshot, not a promise that the same check-cashing model will remain available in 2027. Recheck the effective statute and the creditor’s license before signing a new transaction after the change date.
Which Rhode Island license covers a payday advance
Rhode Island generally requires a license for making or funding loans, brokering loans and cashing checks for compensation. The Division of Banking within the Department of Business Regulation administers these activities and provides license lookup, NMLS and complaint links. For a traditional deferred deposit, section 19-14.1-10(c) says a person with a valid check-cashing license does not need a separate lender or small-loan license for that activity. Verify the check-casher credential in the state records and ask which legal entity actually owns the check or electronic debit authorization.
The licensing rule follows the activity rather than the label. A marketplace, lead generator or payment partner may still participate in a regulated transaction. Rhode Island defines a deferred deposit as a cash advance exchanged for a personal check or future account debit. Capture the legal name, address, customer-service number and license number before sharing data.
$500 amount, 13-day minimum and the 10% fee ceiling
Section 19-14.4-5.1 sets the amount and term rules. The face amount of a single customer check cannot exceed $500, and the agreed deposit date must be at least 13 days after the written agreement is signed and executed. The same customer’s concurrently outstanding checks held by a licensee or its affiliate cannot exceed $500 in aggregate, and the number of concurrent checks cannot exceed three. These are customer-level limits, so using several affiliated brands should not be assumed to create another $500 allowance.
Section 19-14.4-4(4) limits a deferred-deposit transaction fee to 10% of the funds advanced. The fee is separate from ordinary check-cashing fees, so a provider should identify which charge is being applied and why. Compare the amount deposited with the face amount of the check, the stated fee, the total repayment and the number of days. An additional “processing,” “membership,” “verification,” “insurance” or “release” payment should be questioned rather than accepted as part of the statutory 10% ceiling.
A 10% fee on a 13-day advance produces a high annualized cost before a rollover. Use the dates and dollars in the agreement with a calculator, then decide whether the next paycheck can cover the check without displacing rent, utilities, food, medicine or other debits. Rhode Island’s legal ceiling is not an affordability recommendation, and a matched result is not evidence that a licensed check casher or fundable lender is available.
The $500, 13-day, 10% and one-rollover rules describe the framework in force through December 31, 2026. Rhode Island’s 2025 amendments are scheduled to remove the deferred-deposit carve-out on January 1, 2027, so verify any later agreement under the new text.
Written agreement, APR disclosure and receipts
Every current deferred deposit must be made under a written agreement signed by the customer and the check casher or an authorized representative. It must disclose the total deferred-deposit fee in United States currency and as an annual percentage rate, authorize deposit on a specific date at least 13 days away and prohibit collateral. The check casher must give the customer a duplicate original at the time of the transaction. Do not rely on a landing-page summary when the agreement changes the amount, date or debit method.
The check-cashing chapter also requires a conspicuous schedule of fees and a receipt for each transaction. Keep the duplicate agreement, receipt, screenshots of the online consent, bank statement and every message about extensions. If the provider will not show the fee calculation or refuses to identify the entity named on the check, treat that as a verification failure. A valid destination link is not a substitute for a valid Rhode Island license or a complete contract.
The January 2027 statutory change
Rhode Island’s 2025 Public Laws 373 and 391 are scheduled to take effect on January 1, 2027. The published statute shows section 19-14.4-5.1 as repealed on that date, section 19-14.4-4’s deferred-deposit fee paragraph deleted and the check-cashing fee-posting language revised. The General Assembly’s explanation describes the bills as ending the special payday-loan carve-out and applying the ordinary lending-rate protections instead. This page therefore labels the current rules with an “effective until January 1, 2027” date rather than presenting them as permanent.
For a 2027 product, identify whether the creditor is using the ordinary small-loan framework, a regulated depository-institution exemption or another specific authority. Do not copy a 2026 check-casher fee schedule into a new agreement. Ask for the applicable license, maximum rate, fee calculation, term, amount and remedy language in writing, and recheck the official statute or DBR guidance when the transaction date crosses the effective change.
Online matching, privacy and complaints
An online marketplace may collect a Rhode Island application before a licensed creditor appears. Read consent screens for lender partners, credit-report inquiries, bank connections, recurring ACH permissions and onward data sharing. Record every legal entity and domain; the form’s brand may not be the check casher named in the agreement. A ZIP-code match is not a license lookup.
The DBR Banking page provides a license-lookup route, NMLS resources and a consumer complaint path. Include the agreement, fee schedule, check or debit record, bank statements, screenshots, phone numbers and a dated timeline. If a debit is unauthorized, contact the bank promptly; for deceptive marketing or identity theft, also consider the Rhode Island Attorney General, CFPB or FTC. Keep the review links and official sources separate so a referral card is never mistaken for a regulator finding.
A practical Rhode Island verification checklist
Borrow Radar calculators can estimate the fee and annualized cost, but they cannot decide whether the check casher is licensed or whether a scheduled debit fits a household budget. Finish the review only when the creditor, license, amount, dates, price, rollover count and effective-law date are all clear. If the due date would force another loan, request a bill arrangement, credit-union option or nonprofit counseling first.
- Search the legal check casher, lender, broker and servicer through Rhode Island DBR resources and NMLS; confirm the credential is current on the transaction date.
- Check that the advance is no more than $500, the deposit date is at least 13 days away and the customer-level concurrent total stays within $500 and three checks.
- Recalculate the deferred-deposit fee at the 10% ceiling and reject any extra processing, membership, insurance, verification or release charge.
- Read the signed agreement for the dollar fee, APR, specific deposit date, no-collateral promise, electronic debit authorization and duplicate-copy receipt.
- Ask whether the proposal is a rollover; Rhode Island’s current framework permits only one, and a second affiliate should not be used to reset the limit.
- If the agreement is dated January 1, 2027 or later, stop using the 2026 check-cashing summary and verify the new ordinary lending framework before signing.
Rhode Island payday-loan FAQ
- Question 1Are payday loans legal in Rhode Island in 2026?
- Answer
A deferred-deposit transaction is allowed through a properly licensed check casher under the current check-cashing rules. The framework is scheduled to change on January 1, 2027, so later agreements require a fresh statutory and license check.
- Question 2How much can a Rhode Island payday advance be?
- Answer
The current deferred-deposit rule limits a single customer check to $500, the aggregate concurrent checks held by a licensee or affiliate to $500 and the number of concurrent checks to three.
- Question 3What fee can a Rhode Island check casher charge for a deferred deposit?
- Answer
Through December 31, 2026, section 19-14.4-4 limits the deferred-deposit transaction fee to 10% of the funds advanced. The written agreement must state the fee in dollars and as an APR, and no extra unrelated charge should be assumed lawful.
- Question 4How many days must a Rhode Island payday check be held?
- Answer
The agreed deposit date must be at least 13 days after the written deferred-deposit agreement is signed and executed. The current framework allows no more than one rollover.
- Question 5Where can I verify or report a Rhode Island payday lender?
- Answer
Start with the Rhode Island Department of Business Regulation Banking Division license-lookup and complaint resources, then compare the legal entity with NMLS records. Preserve the agreement, receipts, fee schedule, payment records and screenshots.
