South Dakota payday-loan rules: the direct answer

As of August 27, 2026, South Dakota permits payday loans and other short-term consumer loans through a licensed money lender, but Initiated Measure 21 places a 36% annual finance-charge ceiling on covered lending. The ceiling includes charges for ancillary products and other fees incident to extending credit. A loan that exceeds the limit can be void and uncollectible under the state chapter, so an advertised fee is not enough; compare the contract’s all-in APR and every mandatory charge.

South Dakota’s payday-loan rules cap the principal of one payday loan, and the total outstanding payday principal from one licensee to a borrower, at $500. A payday loan is broadly defined to include a short-maturity loan secured by a check, an account-debit authorization or an assignment of wages. The same chapter treats any loan lasting six months or less as a short-term consumer loan, which matters when a lender labels a product “installment” instead of payday.

A licensee may roll over a short-term consumer loan no more than four times. Each renewal requires the outstanding fee and a principal reduction of at least 10% of the original amount. The lender must provide a contract copy with charge method, APR, due dates, delinquency, extension and refinancing terms. These are legal checks, not an affordability endorsement.

South Dakota money-lender licensing and online reach

South Dakota’s Division of Banking within the Department of Labor and Regulation states that payday and title lenders are licensed as money lenders under SDCL Chapter 54-4. Each money-lender location must be separately licensed, and applications and renewals use the Nationwide Multistate Licensing System. The Division also reports periodic money-lending activity and can examine licensee records. Verify the legal entity, license status and service address before treating an online form as a South Dakota lender.

The chapter requires a license to engage in the business of lending money. It also prohibits devices, subterfuge or pretense designed to evade the 36% cap, including arranging a higher-cost loan through mail, telephone, internet or another electronic method when the borrower is in South Dakota. A referral company may not be the creditor, so record the names of the marketplace, lender, servicer and any bank partner separately.

Banks, federally insured financial institutions and South Dakota-chartered trust companies are exempt from the money-lender chapter. That exemption describes the institution, not a marketing claim. If a website uses a bank name, identify the actual bank, the nonbank service provider and the entity responsible for repayment. A lender that cannot provide a license explanation or contract copy should not receive additional banking credentials.

The 36% all-in ceiling and a $500 payday maximum

Section 54-4-44 limits a licensed lender’s finance charges to an annual rate of 36% and includes ancillary-product charges and any other fee incident to extending credit. The anti-evasion rule prevents relabeling a finance charge as a membership, processing, lead, verification or required insurance payment. The agreement should let you reproduce the APR from the amount advanced, payment dates and all mandatory charges.

Section 54-4-66 separately limits a payday loan’s maximum principal to $500 and also limits the total outstanding payday principal that one licensee has made to a single borrower to $500. That is not a $500 allowance per website or affiliate. Ask whether related companies share ownership, servicing or collection and whether another balance appears in the lender’s records.

The 36% ceiling is an annualized price limit, not a promise that a borrower will pay only 36% in a short period or that a lender will approve an application. A $300 advance with a stated $10 charge over a short term still needs an accurate APR calculation and contract review. Use a calculator with the exact net proceeds and mandatory debits, then compare the result with the written disclosure and your expected income date.

Contract disclosures, copies and collection boundaries

A South Dakota loan contract must disclose the amount and date of the loan, due dates and payment amounts, the charge-calculation method, every fee or charge including APR, delinquency charges, extension conditions and refinancing requirements. It must also provide the Division of Banking’s address and telephone number and warn that improprieties may be referred to the Division. The licensee must give the debtor a copy. Keep the copy, application screenshots and every later amendment in one folder.

A lender may not require insurance as a condition of receiving a loan or as additional security when the product does not need it. For a secured loan, the contract should list collateral, liens and title filings. A payday-style authorization to debit a deposit account is not the same as a voluntary optional service; check the scope, timing, revocation method and fees before accepting it.

For a post-June 30, 2015 loan to a South Dakota resident, an entity that should have been licensed but was not may collect only principal under the statute. Preserve the contract and ask the Division for a licensing review before paying a disputed fee.

Renewals, rollovers and required principal reduction

Section 54-4-65 allows no more than four renewals, rollovers or flips of a short-term consumer loan. A renewal is not valid unless the borrower pays the outstanding fee at that time and reduces principal by at least 10% of the original loan amount. For a $500 original payday loan, each qualifying renewal must reduce principal by at least $50, in addition to paying the outstanding fee. Confirm the new balance instead of accepting a “fee-only” extension.

A fifth rollover is outside the statutory limit. Even before the fourth renewal, repeated fees can keep a borrower in a cycle where the next paycheck covers charges but not the original balance. Ask for a payoff quote, a dated payment history and an explanation of any principal reduction. If the lender proposes a new product to replace the old one, compare the new all-in APR and make sure the transaction is not being used to evade the 36% ceiling.

South Dakota does not turn the rollover limit into a budget plan. Put each required payment beside housing, food, utilities, transport, insurance and other debts. If the debit would leave the account short, contact the lender before the due date and request a written arrangement. A credit union, employer advance or nonprofit counselor may provide a less expensive path than another short-maturity loan.

Online matching, privacy and complaints

A lead form can route a South Dakota resident to several lenders without showing the final creditor at the beginning. Read consent language for credit-report inquiries, bank-account connections, recurring ACH debits, marketing calls and affiliate sharing. “Up to $500” is a marketing range, not a statutory approval. Before submitting documents, capture the legal name, physical or service address, license explanation, APR, total repayment, payment dates and cancellation instructions.

The Division of Banking provides money-lender license verification and an online complaint route. Keep the agreement, fee schedule, payment history, bank statements, screenshots, emails and timeline. Notify the bank promptly about an unauthorized debit and preserve the dispute number. Borrow Radar calculators only model the numbers you enter.

South Dakota borrower verification checklist

Use Borrow Radar’s cost, rollover and repayment-budget calculators to test the exact dollars and dates. They cannot verify approval, license status or enforceability. A clear contract, current license, all-in APR, $500 balance check and realistic payoff plan are the minimum information needed for a responsible comparison.

  1. Verify the legal lender and each licensed location through South Dakota Division of Banking money-lender resources or NMLS; do not rely on a brand name alone.
  2. Check that payday principal and the total outstanding payday principal with that licensee stay at or below $500.
  3. Recalculate every mandatory finance charge, ancillary product and required fee against the 36% all-in annual ceiling.
  4. Read the contract for the charge method, APR, due dates, delinquency fees, extension and refinancing terms, Division contact and copy provided to you.
  5. Count renewals and confirm the outstanding fee is paid and principal falls by at least 10% of the original amount on each renewal; stop before a fifth rollover.
  6. If a lender is unlicensed or refuses a copy, save the evidence and ask the Division for a licensing and complaint review before paying another fee.
