Hawaii payday-loan rules: the direct answer
Hawaii replaced its deferred-deposit payday-loan law on January 1, 2022. The regulated nonbank alternative is now a small-dollar installment loan under Hawaii Revised Statutes Chapter 480J: no more than $1,500, fully amortizing, and repayable over two to twelve months depending on the amount.
The familiar two-week payday structure is no longer the state model. A company that offers, makes or arranges a covered installment loan, including online or as an agent for another company required to be licensed, generally falls within Chapter 480J unless exempt.
The offer cards below are candidate matching or referral services, not a statement that each named service or every lender in its network is licensed in Hawaii. Identify the actual creditor and verify its authority, written agreement, interest, maintenance fee, APR, payment schedule and data-sharing terms before submitting or accepting anything.
How the current Hawaii installment model works
A covered loan cannot exceed $1,500, and one lender cannot finance more than $1,500 to the same consumer at one time. The lender must take reasonable measures to prevent a borrower from holding another outstanding installment loan from that lender, a commonly controlled person, a business in which it has a financial interest of at least 10%, or its employee or agent.
That rule should not be summarized as a confirmed statewide database limit across every unrelated lender. The current text focuses on the lender and specified related parties. A borrower’s written or electronic confirmation can satisfy the lender’s reasonable-measures duty. Separately documented loans obtained voluntarily by spouses who are not coborrowers are addressed by the 2025 amendment.
The minimum term is two months when the amount is $500 or less and four months when it is $500.01 or more. The maximum is twelve months. Payments may be due every two weeks, twice monthly or monthly, and principal must amortize across the term.
Interest, APR and the 50% loan-charge ceiling
Chapter 480J limits interest to 36% per year on the unpaid principal. That is an interest-rate ceiling, not a promise that the annual percentage rate will be 36%. Hawaii’s definition of APR follows federal disclosure law and expressly includes charges such as interest and monthly maintenance fees. Always compare the disclosed APR and dollar finance charge, not the interest line alone.
For the current July 2025–June 2030 version, total loan charges cannot exceed 50% of principal. The allowed monthly maintenance ceiling is $25 for an original principal up to $299.99, $30 for $300 through $699.99 and $35 for $700 or more. Partial months use statutory daily factors, and a maintenance fee cannot be added to the balance on which interest is calculated.
For illustration, 36% simple annual interest on $500 for two months is $30 before declining-balance effects. Two maximum $30 maintenance fees would add $60, making $90 of illustrated charges. The lender’s amortization and federal APR calculation will differ, so use the signed disclosure and payment table as the controlling figures. The combined charge must still remain within the 50% ceiling.
Hawaii permits tiered maintenance fees within the overall loan-charge cap. APR must reflect those connected costs, so interest rate, APR and total repayment belong in separate comparison fields.
Written contract and payment protections
The signed agreement must identify the consumer and lender, transaction date, loan amount, authorized interest rate, dollar finance charge, APR and exact installment schedule. It must also identify any agent or arranger by name and contact details and state that add-on products are not required. Those fields help expose a referral site that is presented as though it were the creditor.
A borrower may prepay in full or in part without a prepayment penalty after past-due interest and fees are satisfied. Full prepayment requires refunds of unearned interest and maintenance fees. On request, the lender must provide an oral and written payoff amount for the request date and each of the next three business days, no later than five business days after receiving the request.
The loan cannot be secured by a lien on real or personal property. A lender may offer debit-card payment and charge at most a $1 convenience fee, but cannot require that payment method or impose an insufficient-funds fee for a rejected debit-card payment. The agreement cannot require credit insurance or another add-on product.
Three-business-day rescission and the changed waiting rule
The agreement must prominently state the right to rescind by 5:00 p.m. Hawaii-Aleutian Standard Time on the third business day after origination. It must print the specific deadline. Follow the agreement’s return instructions promptly, preserve proof that the principal was returned as required and obtain written confirmation that the transaction was cancelled.
Do not confuse that rescission window with the former waiting period after payoff. Some older Hawaii summaries say a lender must wait three days before making another installment loan to the same borrower. Act 116 removed that subsection effective July 1, 2025; the amendment is scheduled to repeal on June 30, 2030. A page read after that date should be rechecked against the then-current statute.
Act 116 also temporarily changed the overall charge cap and maintenance tiers. A saved 2021 FAQ explains the original transition, but it is not enough to price a 2026 loan. The current HRS text and signed agreement should lead.
Late payment, deferment and collection limits
A lender may impose a $30 default charge only when an installment has remained unpaid for ten days. A deferment must be documented in writing, and the lender cannot charge a deferment fee. Ask for the revised due dates and allocation of future payments before agreeing; an informal promise by phone is harder to audit.
Collection is limited even when the debt is valid. A lender may pursue lawful civil remedies but cannot threaten criminal prosecution or legal action it is not permitted to take. Unless invited, it cannot visit the consumer’s home or workplace, impersonate law enforcement, imply a government connection or use harassment, intimidation, abuse or embarrassment.
Chapter 480J also restricts contacts with spouses, domestic partners, employers and third parties and bars residential collection communications between 9:00 p.m. and 8:00 a.m. Hawaii time. Keep a call log with time, number, speaker, company and summary; the lender is required to maintain its own communication log for delinquent accounts.
How to verify a Hawaii lender or online offer
Search the legal name and NMLS identifier, not only the marketing brand. Hawaii DFI’s company page links a dated list of authorized small-dollar installment lenders, while NMLS Consumer Access is the current verification route. Match the address and company name in NMLS with the creditor and license information in the contract.
Exempt entities can include financial institutions regulated under Chapter 412 and specified financial-services products, so a missing Chapter 480J license is not automatically proof of illegality. Ask the provider to identify the exemption and regulator in writing. A lead generator’s form acceptance does not prove that its eventual creditor is licensed, exempt or willing to make a Hawaii-compliant loan.
If a dispute remains, send a written complaint with the institution’s identity, dates, people involved, desired resolution and copies—not originals—of the agreement, disclosures, statements, receipts and correspondence. Hawaii DFI explains that it can act only within its jurisdiction and cannot litigate an individual’s private contract or recover money as the consumer’s lawyer.
Hawaii comparison checklist and lower-cost options
Before borrowing, ask the biller for a due-date change or hardship plan and compare a bank or credit-union small-dollar loan, employer assistance, utility relief and nonprofit counseling. Use the installment-payment calculator for the lender’s exact APR and term, then test each payment against rent, food, transportation and other debts in the repayment-budget calculator.
- Identify the lender, arranger, lead generator, servicer and every company authorized to receive application data.
- Verify the creditor’s Chapter 480J license in NMLS Consumer Access or obtain its written exemption and regulator.
- Confirm principal, two-to-twelve-month term, payment frequency, 36% interest ceiling and complete disclosed APR.
- Add interest and maintenance fees, check the tier, and compare total loan charges with 50% of principal.
- Read the dated rescission notice, optional debit terms, prepayment refunds, default charge and collection contacts.
- Save the advertisement, consent screens, agreement, payment schedule, license result, receipts and payoff response.
Hawaii payday-loan FAQ
- Question 1Are payday loans legal in Hawaii?
- Answer
The old deferred-deposit payday framework was repealed effective January 1, 2022. Hawaii now licenses covered small-dollar installment loans under Chapter 480J instead of conventional next-paycheck payday loans.
- Question 2What is the maximum Hawaii installment-loan amount?
- Answer
The amount and amount financed from one lender cannot exceed $1,500 to one consumer at a time. Related-lender multiple-loan restrictions also apply.
- Question 3Is Hawaii’s maximum APR 36%?
- Answer
No. The statute caps interest at 36% annually, but APR includes interest and permitted maintenance fees. Total loan charges are currently capped at 50% of principal under the temporary 2025 amendment.
- Question 4Can a Hawaii borrower cancel after signing?
- Answer
The agreement must provide a rescission deadline of 5:00 p.m. Hawaii time on the third business day after origination and identify the exact date.
- Question 5Where can a Hawaii installment lender be checked?
- Answer
Use NMLS Consumer Access and Hawaii DFI’s company resources with the creditor’s legal name and identifier. DFI also provides written complaint instructions for entities within its jurisdiction.
